Sony Satio recall, offered inferior replacement only just started contract!
Sony Satio 12.1 MP camera phone, waited ages for release. Finally arrived, upgraded via CPW through Orange (2 year contract immediately after my virtually lapsed 18 month contract.
Faulty phone after few weeks, freezing up, switching off etc.
swapped immediately with lots of apologies at CPW stating not heard of any faults etc etc.
Same problems, phone freezes, have to take battery out to reboot. Took in again today, apparently Sony are recalling ALL Satios. Offered inferior replacement (in my opinion) of N97 etc, W995.
I do not want any of these phones and the only reason I signed for 2 YEARS was to get this state of the art phone.
Orange themselves do not want to know as my contract is for the 'Sim card and airtime only'
CPW will NOT give me an I Phone as different tarriffs.
I am now stuck on a contract for 2 years with no Satio and being forced into accepting a phone that was sat on the shelves before I signed my new contract.
Tarrif is dolphin 30 unlimited texts, 600 mins. 2 years.
Can anyone advise what to do?
Or if im stuck what phone would you advise??
thanks people!

Just spoke to dialaphone to see when stocks are returning and sure enough, they're all being returned. This is going to lead to a bit of a pain of a 'pre-christmas rush' when they're back. Like the market isn't a mess for that in December as it is!
Good luck. I'll wait until the firmware update.0 -
I would request that a replacement phone of similar quality is given until the Satio is back from the recall. At which point you will return to the Satio, much like a courtesy car is given when yours is broken, the car is returned once fixed.
You had paid for the Satio not another phone.
Orange won't care, as they are indeed the mobile service and sim, the phone is separate and is an issue with the store, in this case carphone warehouse.
If they don't offer you a satisfactory replacement, then speak to consumer direct about what to do. Imagine you brought the phone on its own, would you be happy to accept another phone if yours was to break, you would want a refund.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -

I would agree with this, but there is no obligation on the retailer for the courtesy phone to be equivalent to the Satio.
OP, you need to decide whether you want to wait for the Satio to be back in circulation (and possibly have a courtesy phone in the meantime), or whether you wish to choose a new phone now.Gone ... or have I?0 -
from what i've read online, it's only the black satio that has been recalled...
i'm probably wrong though0 -
Yeah i sent my satio back within a week of having it ( within the 14 days ) the battery they gave away with the fone was not the same battery that was offered to employees within the fone industry , i read somewhere the recall is due to not being able to create a software update to fix the prolems and its more of a hardware issue, pitty cracking fone imoBetter to understand a little than to misunderstand a lot.0

I would personally quote the sale of goods act to, i believe there is a bit about equivalent value.
Either way there you are a bit stumped for the next couple of weeks, basicly the iphone cost is substantially more than anything else out there. The HTC HD2 is out already and they may get it soon, its a bit cheaper to the phone shops so you may have more luck getting one of them but untill they have it the sato is they best phone they have.0 -
Looking up the sale of goods act.
http://www.berr.gov.uk/whatwedo/consumers/fact-sheets/page38311.htmlQ1. What is an inherent fault?
A fault present at the time of purchase. Examples are:
• an error in design so that a product is manufactured incorrectly
• an error in manufacturing where a faulty component was inserted.
The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.
Q2. Do I only have rights for 30 (or some other figure) days after purchase?
No. Depending on circumstances, you might be too late to have all your money back after this time, but the trader will still be liable for any breaches of contract, such as the goods being faulty. In fact, the trader could be liable to compensate you for up to six years.
Q3. Are all goods supposed to last six (or five) years?
No, that is the limit for bringing a court case in England and Wales (five years from the time of discovery in Scotland's case). An item only needs to last as long as it is reasonable to expect it to, taking into account all the factors. An oil filter would usually not last longer than a year but that would not mean it was unsatisfactory.
Q5. After the "reasonable time" has passed, what can I do?
You may seek damages, which would be the amount of money necessary to have the goods repaired or replaced. Frequently retailers will themselves offer repair or replacement. But, if you are a consumer (not making the purchase in the course of a business) you have the statutory right to seek a repair or replacement as an alternative to seeking damages.
Maybe worth stating you want a new replacement device of the non-black Satio, as yours has an inherit fault that must be returned to the manufacturer and is not repairable or replaceable (as all blacks might be faulty)Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Getting a tad worried now as well. I got a black satio 2 weeks ago from Orange on an 18 month contract. It crashed a couple of times in the first fews days but seems to be have been all right since. I have heard nothing from Orange about a recall - should I be returning my phone?0

It's apparently due to software issues and the word is that Sony Ericsson will be releasing a software update some time in the next week or so.
You might want to have a read of this forum, its got quite alot of satio users who are regular posters http://www.esato.com/board/viewforum.php?forum=350
