    Just because you've used the phone and spent the £120, it doesn't mean you can just get out of a contract you signed. It looks like the shop have cocked up informing Orange that's all. You haven't said, but I presume you're paying the same monthly bill that you were before you upgraded? if so, I can't see why you would think you can just keep the phone and the £120? Surely the shop just need to inform Orange what contract you should be on and that's that.

    Seriously, the most you should be aiming for is for the shop to make sure that your contract runs for 18 months from when you got the phone, not from today.
