    Hi Plok

thanks for that will PM you for the info, really appreciate it.

I recognise that CSA and contact is a different issue, pity the "lady" in question seems to think they go hand in hand.. :-(

What will happen if it goes to the court will it be at a court where it is filed, i.e. local to my partner if he files?

and will she be required to attend or can a decision be made in her absence?

    many thanks again

hi. i think the fee is still £185. i don't know for sure as it's a while cince i filed my papers!!

papers need to be filed at the nearest family court to where the children reside.

they wont do anything if sh'e a no show. this will more than likely happen the first time to make you waste a 1000 mile round trip.

if this does happen, then ask the judge for a costs order to be added if she fails to turn up again. the judge wont be happy with her anyway and could summons her for the next visit.

Dipsy, it is a fairly straightforward matter to take the person withholding contact to court. Visit your local court and get the forms from the clerks office. I think the filing fee is £120.

Have the papers served properly and you should be in Court within 6 weeks. Being an LIP (doing it yourself without using solicitors) is the way to go. You know the detail and as a Brucie bonus the Court gives you a certain amount of leeway because you are representing yourself.

Never mix the issues of CSA and contact - the Court's are not there to deal with money issues. There is a wealth of information out there for LIP's. If you PM me I can send you some stuff that will get you going.

Finally, solicitor or doing it yourself, going the Court route will antagonise the other party and they will use every delaying tactic available. Be warned!

Most certainly the way to go though....go for it :)

Your alternative is to see if you are eligible for legal aid - the rules have changed since I last sent anyone down that route so you need to check if you still have to pay all the filing costs or it can be done on legal aid.

Speedster is right if you are not eligible then go down the self representation route, if you can get legal aid then personally I would go down that route , as judges are equally cross that legal aid has to be used to fight cases such as these.

In the meantime, I would use a little bit of cunning, and I would attempt to maintain contact by telephone and letter (send all letters recorded delivery or email them with read receipts so you can prove that she is blocking all contact) so that if it goes to CAFCASS then you ahve already done half of their work for them.

It also shows that Dad is trying to keep in contact and it is the PWC who is blocking ALL contact.

stubborn is the key word. my ex tried PAS, threats, false allegations, contact blocking, CSA, getting new fella to play daddy..... the lot basically. success can depend on how hard you are willing to fight.

i refused to be driven away from my daughter at the whims of a viscious witch like her. her insanse jealousy knows no bounds.

i dragged her sorry arze to court and showed her up for the moron she is and i now enjoy a high level of contact and i don't have to !!!!! foot around her at the threat of no contact.:T:T
