You are right...there are always 2 sides to every story and it always amuses me that there are people out there who are quite happy to let their children stay with these PWC that can only be described as akin to the Childcatcher (in their words)....it's amusing and also a little scary...but hey, maybe that's just me - always thinking of children's best interests

I would check the calculator because on those figures I made it a flat rate of £5 a week because his income is less then £100 a week, the first £100 is not accounted for. That is if they accept projected incoem figures as Speedster has suggested

so basically £100 a week would make it £5 a week payment
would this then be divided between the two sets of PWC if they both applied to the CSA?
so basically my next question is, as they have done an assesment based on him not being able to show how much he earns- as no accounts as yet, what is the best way forward?
How does he prove that he is taking less than £50 a week?
we need to try and get this sorted ASAP as until the CSA payment is in place she won't allow access, been 6 weeks now and is very upsetting for him and the children, not to mention their extended family, aunts/uncles/cousins 1/2 brother, sister and granpa who cannot see them.

How easy is it to go to court representing yourself?
Will she need to attend court and if so will the court need to be where she lives or where he lives? (she lives 500 miles away with the children)
and do you know costs involved for filing your own paperwork?

Dipsy, it is a fairly straightforward matter to take the person withholding contact to court. Visit your local court and get the forms from the clerks office. I think the filing fee is £120.
Have the papers served properly and you should be in Court within 6 weeks. Being an LIP (doing it yourself without using solicitors) is the way to go. You know the detail and as a Brucie bonus the Court gives you a certain amount of leeway because you are representing yourself.
Never mix the issues of CSA and contact - the Court's are not there to deal with money issues. There is a wealth of information out there for LIP's. If you PM me I can send you some stuff that will get you going.
Finally, solicitor or doing it yourself, going the Court route will antagonise the other party and they will use every delaying tactic available. Be warned!0 -

I recognise that CSA and contact is a different issue, pity the "lady" in question seems to think they go hand in hand.. :-(
What will happen if it goes to the court will it be at a court where it is filed, i.e. local to my partner if he files?
and will she be required to attend or can a decision be made in her absence?
