our bin smashed a window-help

sorry not sure if this is quite the right place but couldn't see where else to put it. Our bin pick up is on thursday mornings and for various reasons we hadn't brought them in last night. It's the big flip top style bins btw. We're in a 1st floor flat and our stairwell goes straight out onto street so we were told to put the bins just to the side of the entrance. This overlaps slightly bt the window of next doors shop. This isn't normally a problem but this morning I saw that the window in that corner (it's made up of several smaller panes) is boarded over so I think that our (empty) bin may have somehow been responsible for the breakage.

I haven't spoken to shop keeper yet as want to have some idea of where I stand before I do-does anyone know whether qwe would be liable for the cost of replacing the window or is it just a case of accidental damage which they would claim under their insurance?

  • If you didn't personally break the window-pane then it may not have been caused by the bin at all. If it was the refuse collectors who did it, it would be up to the shop owner to either claim the expense of repair from the collectors or claim on their insurance.
  • the bin collection was yesterday morning and we hadn't brought them in overnight. window wasn't broken yesterday so was either overnight or early this morning :(
  • Yes, I understood that from your first post but my opinion still stands: if you didn't do the damage yourself then you have no way of knowing how the window-pane became broken. It just sounds like accidental damage and the shop-keeper will probably claim it on their insurance or pay for the repair themselves. I wouldn't lose any sleep over this and I don't think you should either
  • If your bin broke it, then you'll have to pay. If you have insurance you can claim on that, but for a bit of toughened glass it wouldn't be worth paying the excess. I say toughened as there are likely to be special requirements on shop window glass.

    Shouldn't be too much though, it's only a spot of glass.

    If you reverse the situation, imagine if it had b een their bin and your car damaged, you'd expect them to pay for the repair.

    But if it was the bin, it was the OP's bin.
    She never mentioned drunks mucking about with it, or other forces.

    Well I think you'd pretty much have to whether you liked it or not.

    Not to mention, in this particular case, nobody knows what happened at the moment.
