Returned Nokia N80 (NO GOOD) to Orange & Contract

just thought id share my experience with you on Orange
well I got the phone call the other day from orange upgrades,
even though my contract I didnt think had expired, after all only one week ago when i had lost my Motorola v3 I was told by orange i could not have a new handset as the contract had not yet expired so at that point I was sent a new V3& sim)
anyway I had the phone call from upgrades yesterday "did I want a new latest model handset" ?
Well I fancy a Nokia N80 I thought.
As they had none available or online I went into the Orange shop,
I visited 3 stores before I found one,
Got it home put on charge sim card in wait for the normal updated messag etc..
In the morning the Nokia N80 was live and the sim In my old V3 was now barred, soin the bin went my old now defunkt sim card
well a few hours after I found the Nokia N80 to be faulty
The systen kept locking up when a call was recieved cold not answer a call(ok to make a call - but cannot recieve a call)
So i called orange handset faults who confirmed to me that I should return the phone to the store and if i wanted I could cancell the upgrade ( this i requested as I was not happy with the upgraded contract anyway)
as there were extra charges on the new tariff anyway, At the moment im on Premier 400 which is suposidly now not available " nobodys on that anymore" according to the store -
(thats funny as im looking at a bill with it on for last months service)
Anyway i returned the handset this afternoon to the retail store who did not want to take it back due to the no cancelation on upgraded contracts,
After mentioning the sale of goods act ie; GOODS MUST BE FIT FOR THE PURPOSE they agreed to take it back and refund me / cancell the new contract,
Then they dropped a bombshel they wanted the new sim card back otherwise i was not returning the phone as complete,well i dont have it its gone in the bin,they told me to call Orange lost and stolen to get a new sim card, or pay £17.50 for a new sim card,
after numerous phone calls to customer services over a 2 hr period they agreed eventually to suply a new sim FOC "out of good will "
It should arive by the weekend then i can use my phone again,
by the way by cancelling the upgrade im now back on the old tariff i was on last year (premier free weekends etc & Free itemised billing)I found thE N80 looks to be a grat phone loads of features, but no good well mine was no good for recieving calls.
