So why exactly did you think someone was selling a 25k car for less than half of that? A new engine doesnt cost 13k!

Hmmm.........mine cost £12,500 to replace this year!!!

The innocent buyer getting good title to cars on undisclosed hire purchase only works if bought in good faith AND the seller is a motor trader.

OP, is the seller a motor trader? (and more importantly, can you prove it?)

Just for the record - what you are saying is incorrect
The seller does not have to be a motor trader

Apologies, I’ve looked it up and I had it wrong, it seems……

If an innocent private buyer buys a car with undisclosed outstanding hire purchase he gets good title and the finance company lose if they can’t recover off the person who took out the finance.

If an innocent garage buys the car with undisclosed outstanding hire purchase they don’t get good title and the garage lose if they can’t recover off the person sold them the car. As the garage don’t have good title they can’t transfer title of any subsequent buyer.
  • OP, just to clarify, I'm assuming you've checked and the addresses etc. from the seller were false? Is there any way you could get the lease co. to release the details of the seller for you? I was in a similar situation to you a few months ago, although I had the log book, the car was a mess and had a fake MOT certificate etc. I had no idea of the seller's address but I found out from searching online that he was selling other cars using the same mobile phone no. I contacted a private investigator who was willing to find out the seller's address by replying to one of his adverts online and following him home (apparently they get lots of similar requests). Thankfully it didn't get that far and I managed to get the seller to give me back my money after threatening him with the police, but possibly could be an option for you if you're willing to do a bit of digging?

Scrap all this, seems you may be fine from the above post, hope it all works out OK!
  • Thanks to everyone!!

From what you say "stand up guy" hopefully this will be the outcome!!

Since I posted I also have another issue . The car has a couple of lights that have came on on the dash!. I went to a local dealer first but they have advised to go to a Mercedes garage direct. Do you think that would be adviseable. e.g. Could they take the car off of me? or would I be better to wait until I get the keeper and docs completed sorted!! This is an out and out nightmare!!

Let me know what you think. To date evyones replies have been brilliant and thanks alot for helping. Maybe light at the end of the tunnel!!
  • If that car has been reported stolen by the leasing company, you stand a very good chance of being arrested if you are caught driving it. The civil law arguments over whether you have legal title to the car or not won't count for anything in the eyes of the police if it pops up on one of their ANPR machines as being reported stolen.

I wouldnt spend another penny on it.
  • If the lease company sold it, it would still show in there name if a dealer had bought it.......

I would find out if they have sold it first before you panic

Why not try going the legal route and apply for a log book through the dvla
