    Unfortunately people have to realise that they have to pay child support - and factor that into their budgets immediately that they know they need to! Sad fact of life but there will be those who will find it difficult, but they can't choose not to pay.

    Where the CSA have it wrong, there are ways to get it sorted out and it will happen - you have to persevere and take it as high as you need to, but it will be done. If overpayments have been made, the case will be adjusted so that it will work out in the end. I know it is frustrating, believe me I have been there (on the other side mind you - having to struggle financially because of no support - but there was no consideration as to how this was affecting us!!!! WE had to get on with it - no different to struggling NRPs).

    You say you have taken a loan out to cover unpaid nrp payments.
    Do you claim child tax credits/working family tax credits etc?
    Be aware that these have to be paid back to the secretary of state out of any money the nrp may pay in after getting a loan!
    CSA "re-instated" 6.9k of "suspended debt" I was unaware of, and it turned out my ex and kids were getting just £341.60 of it - rest to the govt!!
    Hope this doesnt happen to you as obviously if you took out the loan relying on his payments to help cover it you may be left in a hole. BEWARE!!

    And it just goes to show that the CSA do not FORCE people to take out loans - the courts did so in a round about way to my ex, but he had told them initially that he was remortgaging his house to get the money that he had refused to pay - his fault that the debt accrued. The courts allowed him to sort it out but lost patience when each time he attended, nothing had happend. They basically gave him an ultimatum - pay in 2 weeks or go to prison. He paid. The CSA could not do that, nor did they try to. They had 3 charging orders on his house, but still did not force him to take out any loans or credit cards etc. It really is a choice, but the CSA have to inform people how they will accept payment. Up until a couple of years ago, it wasn't possible to pay them with a credit or debit card - now it is, so they have to tell people that they can pay that way if they wish. They also have to inform people what action they will take if they don't pay. That isn't financial advice, it is advising of their options.

    theoritically, yes. practically, no.

    the main problem with the csa is their incompetency, combined with their abuse of power when collecting fictional arrears.

    also, they seem to pick on the easy targets, (the compliant ones) rather than doing their job and tracing the errant ones.

    it's all about meeting targets for their bonus' and nothing to do with the children. never has been. they were set up to claw money back for the massive benefits bill run up by single mothers.

    reducing child poverty slogans etc are just propaganda.

    What? The PWC has to take out a loan to live on because the NRP fails to pay - she has to pay that loan back plus interest. She gets tax credits - loans don't affect those in any way. The NRP pays up so the PWC keeps it - she hasn't had anything extra as she has had to pay back the loan. Your argument doesn't make sense.

    The suspended debt still existed - debt which the NRP hadn't paid. Unfortunately, if it is the CSA's fault that the debt built up, there is no provision to write the debt off - it should be treated more leniently though IMO eg CSA pay the PWC and collect from NRP over a longer period, but I don't make the rules, so it doesn't matter what I think! The NRP has to pay it back.

    the PWC loses the money because if the NRP had paid they would have had the money as income and therefore recieved less WFTC-so they have to pay it back!!

    Child maintenace is not counted as income for working tax purposes.

  • So explain why the accounts dept at Belfast themselves supplied the figures and informed me that " you're debt is not with the nrp-it is with the secretary of state"?

    They were the ones who gave me the figure my exd would recieve!!
  • Are you trying to tell me that this government.............THIS GOVERNMENT??............. Set up the ridiculously expensive CSA purely as a non profit exercise to make sure that NRP's pay a rightful amount of money to the PWC???
