3 upgrade - crap phone!

I upgraded with 3 last week to a Sony Ericsson C903, unfortunately the battery doesn’t last the day, in fact it lost 30% of it’s charge overnight with nothing running.
I’d read the reviews of the phone and they were inconsistent, some say bad battery life others say great phone, so you really don’t know what you’re getting unless you try it out which invalidates the return policy.
I rang customer services and explained the situation but ……. As I’d used the phone blah, blah, blah ….the 14 day refund policy doesn’t apply …. Blah, blah, blah (how are you meant to know a phone doesn’t hold it’s charge unless you use the damn thing!)
A replacement phone is being sent out to me tomorrow, but what I want to know is, if I don’t open the box and therefore don’t use the phone—can I send this new phone back under the 14 day refund policy and cancel my upgrade?

No, it doesn't work like that, sorry.
How long did you charge the battery for ?
The longer the better, over night is good and give you better battery life over all...0 -
Didn't think so! (but hoped)
When i received phone I charged it overnight before use, but it has still needed charging every evening, even though it hasn't been used much - just gotta hope it was a duff phone and the next one is better.
