I have just spoken to the Financial Ombudsman who have informed me that Black Horse weren't regulated at the time we took out the original loan, December 2003, so they must've had underwriters for the PPI. I'm confused now.....once I find out who the underwriters were at the time do I address my complaint to them? Not sure how I go forward with this and I'm feeling very downhearted about it all now :o(

    Hi there

Mine is now with the FOS after it being turned away a few times, not Black Horse though, but what goes for one bank should go for another.

In your case write to BH and ask them to send you a copy of the PPI policy documents, the underwriter/insurer details should be enclosed on them.

I had to do this with the one I am stating, where now the FOS have finally accepted this and taking it to the underwriter/insurer, I must thank our Marshallka for this though, it was all down to her encouragement I went ahead with this, especially after being turned away a few times.

Have you checked out on Marshallka's above Resourses sticky thread above?
There are some info on underwriters on there, good luck and please keep us posted.

  • Thanks for that. Been in touch with Black Horse this afternoon to find out who the underwriters were.....talk about trying to get blood from a stone! Finally managed (without torture!) to get it out of them and the underwriters were Lloyds. I kind of figured Lloyds would be but wanted to know for definite.

I know it's a long shot but does anyone know if all these rules and regulations apply to offshore companies. I'm in the Isle of Man so I'm not sure if all this stuff applies.

Anyway, I've done another letter and I'll get it sent recorded delivery tomorrow. I am determined to fight this all the way cos I believe we could be due quite a nice sum if all works out.

    Hi there
I'm sure it will be fine and to what I know of it makes no difference where you live.

You could actually ask the FOS to write to them on your behalf as well if you want to, they should not mess them about.;)

Was this to Lloyds of London and not Lloyds bank??? I would not think LLoyds bank would be underwriters but not 100%.... I would check on this though??????
  • Lloyds bank, apparently. The bloke I spoke to in the local Black Horse office was very sketchy with his info.....whether that was because he was trying to put me off or he just didn't know, I'm not sure. He still insists that I write to Black Horse in Cardiff (I guess with them being more or less the same company Lloyds/Black Horse) so that's who I've addressed the letter to but I'm also going to email a copy to the Ombudsman. They've logged my complaint and given me a ref number but I'm not sure what they'll do about it with it being a pre-2005 loan.

I also requested a copy of the terms and conditions of the PPI but as it was almost 6 years ago they've been archived. They asked me to call in to collect them on Tuesday.

Do you know if there's any way I can easily double check the underwriters, marshallka?

As that is who BH have told you to write to then you have done the right thing in writing there. If it is wrong then FOS will get the right one but you have to give them 8 weeks to sort the complaint like with any complaint. If after 8 weeks they do not uphold it then being insurers/underwriters they would be under Compulsory jurisdiction even in 2003 when you had the loan and FOS would be able to look into it for you from what people have posted on here. FOS is trying to hold underwriters/insurers responsible for misselling in cases like yours.

    Good luck
  • Thanks for all the info so far. I'll keep you updated.
  • The underwriters of BH are Lloyds TSB. FOS are currently dealing with a claim for me from 2001 and are going for Lloyds TSB as underwriters not BH.
  • That's very useful and interesting, thanks very much. Can I just ask please.....did you contact BH initially or have you had any contact with Lloyds TSB prior to going to FOS? I'm still a bit unsure about it all with being on the Isle of Man but I'm feeling a bit better now because with Lloyds TSB not being "offshore" then my claim may well work out! Thanks again for that, it's really cheered me up:rotfl:
