    Witness evidence is also fairly good evidence - particularly if someone else was with you. If you were to take them to Court, it is up to the Judge to determine if you are to be believed or not.

    Unless the retailer can show that you are lying (e.g. they didn't stock them), then most Judges will take the view that you probably bought them from the retailer.
  • to be honest if I was the retailer and someone was taking me to court over a pair of wellies I would believe that they bought them from me for all that effort!

    Precisely my point - they shouldnt have got a hole after two months, especially as they cost £25! Not sure where the "suspicision" comes from - they just have a policy which is really hard to comply with. After all, who keeps receipts of everything single thing they buy?
  • Well you don't do you, not for a cash purchase. I'd to go back to the shop again, sometimes being a 'nuisance' makes them realise you're not pulling a fast one, if you get no joy then contact the company and tell them you had no help from the shop - they might be only too happy to help, worth a try - especially if you let them know how wonderful their products normally are and how you've been buying them for years etc etc ;)

    Certain people try to scam shops by returning items of clothing after they have had a year or so's wear,without a receipt,claiming they are a few weeks old.I am not saying that is you,but it is commonplace.
