No Replacement for Wellies that leak!

My mum purchased some fairly expensive Wellies for my husband from The Range in Southampton and after two months, they have developed a hole near the sole, making them useless in this weather.

We tried to return them for a replacement but were told that because she paid by cash and didnt keep the receipt that they wouldnt replace them. Their Customer Services Dept at Head Office says that this is their policy and that they are acting "within trading law". Does anyone know if this is correct?

    you should be entileted to a replacement under the sales of goods act 1979 its says reasonable time and to me that would be longer than 2 months for wellies

    They are correct they are within their rights to ask you to proof you purchased the boots from them and not from some other retailer.

    True, but they paid with CASH and have no receipt, so how do they prove they've only had them for 2 months?

    They would have to investigate how long this "range" has been on sale, and if it was just over 2 months, then could claim they can't possibly be older than that.

    Surely this is common sense to you that if there is no proof of purchase then how can you prove you bought them from this place. The only other thing is whether they do 'own range' which is exclusive for themselves but if they don't then the retailer doesn't have to replace or refund as there is no proof of purchase

    Agreed, prove how old this range is. If older than 2 months you have no proof im afraid. If less than 2 months since release then your ok to claim under that
  • Could you try writing to or emailing the manufacturers and explaining your problem? They may be more sympathetic :)

    Yes will try that next - thanks - and will also try taking them back to the store in Southampton..Someone has suggested that if she bought them with cash in the last few months they might have some sort of record??

    I am not surprised they are a bit suspicious,even though it is true,rubber wellies getting a hole after 2 months sounds hard to believe.

    I'm sure they would have a record of selling a pair or indeed several pairs of wellies for a certain sum on a certain date but that doesn't mean it is your mum who bought them, Nor indeed are they obliged to use their staff time in searching through their records for such a transaction.

    Think this needs spelling out:-

    No receipt or proof of purchase = no chance (unless you are regular customer and you might get some goodwill).
