I also get £92 per week with the calculator...if you put £82 it gives you £5
Do you receive tax credits for your 3 children..there have been posts on here about that being included as income also but not sure whether that is CSA1 or CSA20 -
You're spot on.
I can see that now.
I did put that I get benefits hence the £5 figure. Assuming that child tax credit was a benefit.
I take it I'm wrong on that and I should work on the details that I don't get benefits.
Many thaks for your imput on all of this.

No, child tax credits aren't included as a benefit ... but unfortunately they are included in your net income figure. All child tax credits are included, working tax credits are included in whole if you earn more than your wife, half if you and your wife earn the same and not at all if your wife earns more than you. My wife seems to think I'm on CS1 as the claims have been going on since 1999/2000 but looking at the paperwork, it has a date of 21/09/04
Looks like I'm on CS1 after all.
It's not looking good for me after all.
As I pay £20 per week on a private agreement straight into her bank account, could she claim back pay as well for the difference in amount that I've been paying her... Based on if it was to come back as £92

Right ... so how did you come to pay £20 a week to her? Did she contact the CSA way back when and then you both came to a decision to pay her an amount directly, so the CSA either didn't do an assessment way back when ... or the original calculation was £20 a week.
Was/is your ex on benefits (Income support etc) since 1999/2000?
If you had a an assessment done back in 1999/2000 saying you were to pay the ex £X a month but you paid less, then they could backdate the missed payments. As you had a private agreement, they will ask your ex if she has received any payments off of you. If she is not nasty about it, she will tell them the truth (or perhaps you have evidence of the payments, a receipt or bank statement clearly showing payments marked CHILD SUPPORT) Unfortunately if you have no evidence and she tells the CSA you have paid nothing, then they will take her word for it.
If she has been on benefits since 1999 then she was, back then, only allowed to receive £10 a week in child support payments before having to declare it to the benefit people. It increased to £20 a week last October.
If the CSA assessed back in 1999 that you had to pay for example, £30 a week and you paid £20 ... I believe they will backdate it and want the extra (depending on whether the PWC confirms you paid her some) as the money will be owed to the PWC and/or the Secretary of State to pay towards her benefits.
If you were never assessed or the CSA case was closed down temporarily prior to you coming to a private agreement then I believe the reassessment will just commence from the date they requested your new wage information ... so you will be accruing arrears of £92 a week from that date, which can really add up if it's been months and you've not been putting money aside. Have you still been paying the PWC the £20 a week since the reassessment by the CSA?
Why did she go to the CSA for a reassessment? Did she not contact you first to try and sort something out between you, with regards to an increase in the private agreement arrangement?
That might be all rambly and not much help sorry. You really need to wait until you get the reassessment from the CSA for the new figure and expect arrears to be included in the assessment. Depending on the amount, you will be able to tell whether they have backdated the arrears back to a date after 1999.
You should also request a copy of your files from them under the Data Protection Act so that you can check they have done all of their assessments correctly and sent you out all the correct documents as they should.
Good luck.August GC 10th - 10th : £200 / £70.61

Right here goes,
I was paying through CSA, then when I had my first child with my current wife I came out of work and got nill assessed.
When I started work again, my ex wife and I came to a private agreement to pay the said £20 per week.
This goes straight into her bank account and states child maintenance on my bank statements.
She recently asked for more money, but we couldn't come to an agreement as I have 3 small children living with me and have a lot of outgoings.
Hence, she contacted the CSA again.
My ex works full time so I'm unsure if she is claiming benefits. Maybe working tax credits. I don't know.
I havent actually been re-assessed...
This is what they have asked for:
We have become aware that you may have had a change in your income/housing costs.
They have asked for payslips from both my wife and I... they arn't getting hers!!!
Benefits, inc.. child benefits.
Savings, capital or investment for all the family inc.. the kids.
Pensions.
If I'm renting my house or other property... I'm not anyway.
Any other source, inc.. working families tax credit.
Mortgage interest payments.
Council tax rates.
No forms to fill in, just send all the original documents.
Hope I havent missed anything out.

When the PWC contacted them and said she thinks your income has increased, that would have triggered the reassessment then.
Hopefully as your ex has been working full time all this time, she wont have been in receipt of any income support, so there shouldn't be any payments due to the secretary of state.
As you had a nil assessment (with the private agreement going ahead), this is the first time your ex has asked for a reassessment and you haven't notified them of any change in circumstances either the arrears should only be backdated to the date of the reassessment. So probably the date the PWC rang to notify them she thinks you had an increase in wages.
The problem with the asking for your wife's details is that in some cases, the NRPs partner's information may mean a decrease in child support payable, in some though, it will mean an increase and as there is no straight forward formula to working out CS1 payments, it's difficult to work out with out knowing all the ins and outs to their calculation.
Kelloggs36, a poster on here, is very knowledgable when it comes to the CS1 assessments. You could possibly ask her if she has the time to take a look at your details to see how much the CSA will ask for so you can try and get a heads up of what is going to happen.
I may be mistaken on that info ... I'm not 100% certain, someone will come along and correct me if I'm wrong.

Also, hindsight is a wonderful thing, but coming to an agreement with the PWC when she contacted you might have been more worthwhile than her going to the CSA again
