Can I cancel my contract?

I am wondering if anybody can help.

I have had my contract with T-mobile now for over a year, it is due to run out in march next year. Over the past year the network coverage has been very good, however since monday morning (9th November) I have had no network coverage. I have rang them several times and each time they tell me that they are working on it and say it will be fixed that day. It is now 5 days later and it is still not fixed. They now tell me that they don't know when it will be fixed. As I need a mobile I have had to go out and get a pay as you go to tide me over till it's fixed, but why should I have to pay for calls when I am already paying for them with T-mobile.

I have asked if I can cancel my contract and move my number to another network, but they say I can't until March 2010. I said that wasn't acceptable as they couldn't provide the service I was paying for, they told me that they don't always guarantee excellent coverage. I told them I would settle for average as even that would be better than no coverage.

Does anyone know if there is anything I can do?

  • Quite simply no, there is nothing you can do. Your contract will say that they do not guarantee a service everywhere. So you have no legal right to cancel as they are not in breach of contract.

    There have been a few cases (one where someone took Orange to court and he won - although Orange didn't turn up to defend anything) where people have managed to cancel though. I think it's down to if you get the right person on the other end of the phone. They might let you cancel as a gesture of goodwill, however I think this is highly unlikely.

  • you should be able to get compensation as you cant get a service.... ring em. but as 4 canx.... quite simply no.

  • A single cell issue can often take a week or more to fix depending on the fault, if they need parts etc.

    You are not entitled to end your contract because of the loss of service. At best they will compensate you for the loss of service based on how long the issue has been going on.
