    Someone that cannot get out of bed in the morning does not qualify for DLA. Someone that needs help with getting out of bed in the morning does qualify for DLA. There is no reason why the latter should not be working.

    Your other example has absolutely no relevance so there is no need for me to comment on that.

    I am sure that you were trying to help, but your source of information is clearly misguided.

    look im trying to explain the job must fit the care needs! which your saying to ! ok that example wasnt the best but you should be able to get my point

    All i will say is good luck and that my " source" isnt mis informed as he has represented many people for many years and the majority of these people have had the problems sorted out thanks to him

    P.S I know thats a furture comment before you say anything

    Actually it is a further comment. Nonetheless, a DLA claimant only needs to report changes in their care and mobility circumstances. :p

    You know exactly what I meant that I was saying I know this is a further comment even though i said i wasn’t going to post anymore

    I’m not going to apologise for putting in one wrong word in I’m dyslexic and in alot of pain so congratulations on putting someone down over something so small

    And even though I am dyslexic doesn’t mean I lack knowledge and I’m stupid

    I will not argue over this anymore as its digressing from the original point and I’m not going to take away more space on the this thread
    I truly wanted to help the original poster my advice to them is to go to the CAB or DIAL explain everything truthfully to them and they will help you don’t take any advice on here including mine as everyone’s issues are different.

    The fact that someone is going to work when they weren't before is a change of circumstances..... the reason they put a change of circumstances is so it covers everything

    I've always been told to only inform them if my care or mobility needs change.

    It's like they know I'm living away from home; but I have not been asked to fill in a form regarding change of circumstances.

  • I would try not to worry to much ....technically you can work and claim DLA but they can allways challange this. As of my knowleadge you can work and claim DLA they do need to know about it and they could argue that if you can work then your fit enough ( which we know isnt allways true)

    The the factors they take into account is if yes you can work but you do not know and can not predict how your condition will vary from day to day so you may go in three days one week and then none the next for example then you should be still entitled and also if your care/ mobility needs are the same. Also you would need some understanding in place with your employer to get around the days which are bad.

    This is what my Dad said to me in general conversation about benifits (hes an ex CAB advisor) but in his own words its never clear cut and he also explainned that people can get working disabled tax credit, so i would assume as long as you still have the needs at home and at work then you should be entitled.
    Thats not correct at all.
    Work has nothing to do with DLA at all as you can claim DLA and work all your life.
    There isn't even room on the form to say if you are working or not when you first claim, so why would DLA want to know if you decide to start 2 years after claiming?
    An employee can work out a decent way to work through good and bad days with their boss quite adequately without the need of DLA, so I am completely baffled as to what you are talking about.

    There is no requirement to inform DLA that you have commenced work.

    DLA often receive notifications from a Local Office that a customer has commenced work, these are looked at by the DM who will decide of the work casts doubt on a persons entitlement. If they feel it does, then further evidence will be requsted in the form of a claim pack or medical evidence.
  • i wouldnt tell them if i work it is none of their business. its bad enough i have to tell them i need help with personal care and a bath chair at 27.

    my mum also gets dla for her condition yet works 30 hours a week and never hid the fact she works.

    she doesnt walk 100 metres to the bus stop and her work and made changes for her. why should she give it up because she is disabled.

    i plan all along that i will eventually get a job because why should we let the disability win.

    What are you referring to with this cloak and dagger talk?
    DLA do not care about people working. DLA is so that if someone needs extra care and support so they can go to work the extra money helps with that.
    For example, my friend is wheelchair bound and cannot walk at all. She is not able to get in and out of a shower, bed or a car without help. She cannot just walk to the end of the road and get on a bud to work like 'normal' people, so she goes to work in a Taxi. This extra NEED because she is DISABLED is EXACTLY what DLA is for. She doesn't have to sit and home and never work because she can work with her hands and voice etc etc part time but she most definitely needs help with her mobility and her care.
    Why would DLA be even remotely bothered that she is working?
    Unless you have cast iron proof with links, don't bother given people the wrong information. You could influence someone not to claim because they think they won't get it as they work.

    I honestly cannot remember ever being asked if I work or not. My working has absolutly nowt to do with my condition. It's my body thats giving up on me not my brain.
