It is actually 14 days after the offence, not 28 but if it goes to the registered keeper within that time it is OK as it has been deemed to have been served. The fact that someone else was driving can take longer but the fact remains it was served correctly.

I have to disagree with Trippy though. It is not really a case that the Police don't care who was driving they just want their money as they are just enforcing the law. As I said previously, if you really don't know who was driving then you must say.

Part of the Furniture Combo Breaker
    Hi
this happened to me and my oh, we were moving house and were all over the place using the same car for trips back and forth between properties. Neither of was aware of being 'clocked'. We did not know who was driving the car at any specific time and we said so.

For a couple of months we got letters to 'demand' to know who was driving. We told them a number of times, we did not know and still got letters from them. Then we suddenly stopped hearing from them.

And, yes, if we knew who was driving we would have admitted it.
    Hope it gets sorted.

    just to add my story:

got a NIP, didnt know who was driving (true!) so wrote that on the form AND SIGNED IT- sent it back.

they wrote back and said, heres your form back....you MUST tell us whos driving and heres a pic to help (pic was rubbish)

i wrote back and said, "i'm happy to state that I was driving and take the points. However, please confirm in writing that i can do this - i dont mind lying on the form to say i do know (when the truth was i didnt) but dont want to get in trouble for it"

they wrote back and said forget it.
