Id love some help, im close to breaking point.

Hi there,
Several weeks ago my Dr assured me he could get my £41,000 of debt written off due to Bipolar Disorder. I accrued the debt whilst going through a severe Manic period 2003/04. I finally had to give up work in 2005 and have been terrified since.
Well...up shot it, he can't. He and CAB are still working on it, but CAB have told me it is very unlikey so I have made the decsion to go bankrupt. Im currently having to take antiphychotics to cope...imagine being that raised up to be so cruely dashed down again?.
I have been on benefits since 2005, reciving Incap, HB and DLA at Higher rate care, I have no home, no savings. I live in rented accom (I have told estate agents about impending Bankruptcy) and he is fine with that!
My MAIN worry is that if my Mum finds out, which is laughable really as im in my late thirties, but I just can't face it.
None of the debts are hers, she knows nothing about them, and I took them out when Id long moved out of the family home.
Ive not eaten or slept in days, and I haven't even filed yet because some things are really worrying me.
I am concerned about this bit:
4. Q. 8.3
If you have any interest in or the use of any other property you should provide details of your interest. For example you may have an interest in a property under a will or you may have the use of a property which you pay for but do not have a tenancy agreement for. You do not have to live in a property to have an interest in it, for example you may rent a garage or storage unit.
I am sure my Mum has made a will stating that when she dies I will inherit whats left, she owns her own home. Will they contact her and try to take it now if I go bankrupt, is this what this means?
I can't face that, she is not responsible for the debts, I am, but what does this Will bit mean?
Any answers, guidance would be so helpful, im sat here in floods of tears right now, so apologies for rambling!

Dont worry they wont want to take it now, have you incurred ant credit since 2005, if not i think with the bi-polar disorder it will be a very straightforward case for the ORHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

I am pretty sure this part refers to an impending will ie someone has died already and you are waiting for proceeds or legacy.
You or the OR have no way of knowing when any person leaving you money will die, and in your mother's case it will hopefully be man years after your discharge when it will be yours anyway.
Please tell your mum. She will support you through this.0 -
I think it probably means if someone has died and the will has already come into effect - eg for example if there is someone living in the house but it reverts to you when they also pass on, or if the house is waiting to be sold and the proceeds split between the beneficiaries.
Don't panic, no-one is going to take your mum's house if you go bankrupt just because of a will. Her house would only come into it if it was already in your name as well as in hers, that sort of thing.
Try not to worry, you've had a shock so things are bound to be going round in your head. (easier said than done, I know.)All shall be well, and all shall be well, and all manner of things shall be well.

Don't worry about being on a will, the house isn't yours for them to take unless anything happens to your mum god forbid. As for the rest I'm not the best person to help but the part where you said you had your hopes dashed well I know how you feel and going through this is like a rollercoaster there will be many times that you get your hopes dashed but please remember the rollercoaster always goes back up again. Don't give up and going BR is not the end of the world if you have no assets for them to take. Get yourself a Statement of affairs sorted out http://www.makesenseofcards.com/soacalc.html and start to plan what you are going to do post BR if thats the route you want to take.
Make a budget and stick to it otherwise you will end up back here.
Good luck and remember things will only get better once you take action and you will feel the stress lifted off your shoulders when you do.0 -

Can't add to the excellent advice you have already had but just wanted to say you are doing the right thing for you. It is not an easy thing but it will make such a difference in your life.

:grouphug::grouphug::grouphug: a few dodgy group huggles first. Sounds like you need them.
Hopes that come crashing down to the ground are heartbreaking but at least it will help in that road to getting your life back. I hope that the CAB are assisting in the BR forms as you can use their assistance.
On the subject of the will.....remember wills can be changed at anytime & its down to the individual as to who they leave their stuff to. My personal feeling is that its a `no` as at this time you really don`t know actually.

How wonderful you all are.
In more rational moments brain is telling me everything will be OK, you are all telling me it will be OK, the CAB have told me it will be OK, unfortunately my illness has to argue with it, and around this time everynight I get the running comentary in my head of everything that WILL go wrong, and I can't make it stop.
