How Do I Stand Legally??
CarPhone warehouse were advertising on the internet the K700i on BT Mobile 200+ for 14.99 pm for 12 months (cashback deal) on the 5th Jan 2005. I contacted them about it (on the 5th) and asked if the offer was avaliable in store or web only. The guy said he would call me back to confirm. No phone call so on the 6th I called again and ordered the phone directly from them and confirmed the details of the offer and that it was still avaliable. This was confirmed by the employee and also on the web so I ordered the phone. The phone arrived today (7th) but with no details of how to reclaim the cashback. I then called CPW to find out what month bills were to be sent in and they have now told me that I was too late for the 12 month cashback deal (even though I confirmed several times with the employee and also checked the web) and they have put me on a 8 month cashback deal!!! I was then put through to a manager, who basically told me it was tough and that was the deal, even though I was sold by the employee the 12 month deal. Are they obliged legally to honour the 12 months cashback deal or can they do as they like??? ANY help much appreciated as I have to call the manager back later on today to discuss further, even though he was adamant that it would not change!! Thanks.

Legally they have to honour the terms as they were on the day.
On your invoice, which would have arrived with the handset, did it not state the monthy tariff? It usually does on their invoices.
You may well save yourself a lot of hassle by simply returning it to them and obtaining a refund.0 -
Hi Steve, all it says on the invoice is BT 200+ which is the tariff, it mentions nothing about the 12 or 8 month cashback!!! Would really like to fight this as I made sure several times with the employee that the offer was still valid. Sending the phone back is the last option!! Any legal quotes I can throw at them??I say what I like, I like what I say!0

I'd be tempted to use the 7 days distance selling regs and send it back, by the time you prove whether or not you are getting the 12 months cashback and I bet they settle on 8 months you're then stuck with it0

I'd complain directly to the owner of CPW, don't bother with customer services ...

As said before, do not want to send the phone back as the reason I went for it over other suppliers is that it was a good deal!!! Any legal quotes I can call them with later?? Hi again. I hope that when you spoke to them today that you:
1. Took the name of the person you spoke to and made a note of the time you made the call at?
2. Got this person to email or write to you with the detail?0 -
It just shows you have to be firm with these people otherwise they will renage on the deal. I urge anyone in the same boat to do this same.
