Sending a phone back on Upgrade - Where do I stand?

Hi,
I hope someone can help.
I upgraded my phone with Orange 2 weeks ago to a Blackberry Curve. I've been with Orange for alot of years.
I was put onto a new talk plan and sent a new phone. My new contract came into effect on the 7th November.
After a couple of days I noticed that the Internet was quite slow which was starting to annoy me and realised it was not even 3G. So under the terms and conditions, I had the right to send it back to Orange within 7 days and arrange a different handset.
On the 7th day I rang Orange and informed them I wanted to change the handset. They said, no problem send the Blackberry back to them and call a few days later to arrange another phone.
I sent the phone by special delivery last Wednesday, and was told it would get there last Friday. I have rang Orange repeatedly and they have nothing on the system that it has reached them yet.
They told me it takes days once they receive it to go through the various checks in the depot and onto the system.
I have just got off the phone to Orange again this morning and there is still nothing on the system and told me to ring up again in another couple of days!!
I'm very concerned that I am paying for a contract for services that I'm not using as I have no phone. I have not used the sim in nearly 2 weeks now.
I told Orange I am now at the point of wanting to leave them completely if this is not dealt with asap. My question really is, If I have sent the phone back, is the new contract still valid? what exactly am I paying for at the moment? why should I be paying for blackberry services etc if I don't even have the phone anymore.
by sending the phone back to them have I cancelled the contract? Can I ring up again and tell them I want to leave, or am I still tied into another contract with them?
I'm disappointed in the customer service, which is a first because Orange are usually quite good, but I'm not prepared to be messed about. I'm at the point now where if it isn't sorted by the weekend, I want to leave and go to a different network but need to know where I stand with this new contract which is/isn't valid anymore.

Normally when you return a phone back if you have to call and get a code and also I think they send you a pack to return the phone in.
You might want to see by chasing ur tracking number to see if orange have signed for it. if they have then let them know it has been signed for0
