Hi, I dont kow if you can help me, someone told me neverindoubt was the person to ask!!

I have been on a dmp since May last year, one of the people I owe money to is NEXT directory, they originally accepted the reduced payments & stopped interest but today I have received a letter from a Debt collection agency saying next have now instructed them to recover the money (£724) outstanding on my account, and I need to pay it immediately or they will take legal action which could involve an attachment of earnings (not sure what this is) with present employer or an application for a warrant of execution by bailiffs against goods owed.

I havent a clue what any of this means & am panicing big time!

Someone on another thread told me it would be worth requesting a CCA which could 'send the debt agency packing'!
    Can you advise please?

    Thanks very much

Long time no see! Time for a update. CQ have purchased an account from a company that had not previously supplied a true copy of a CCA , only a copy of an application form . Despite several demands and threats of action from DCA,s CQ say they now own the account , no proof sent ,and started demands and threats . I pointed out the lack of a CCA to them . They claim it will be supplied shortly!

    Can anyone help?

I borrowed 6000( I think ) back in 2001 from lloyds, was told verbally the insurance covered everything... it didn't all it covered was 12 months unemployment and I was unemployed for a while after that, The debt was handed over to BLS but with all the interest added that would have been paid over the whole term so I now had a debt of around 12,000.

I'm vague about the original figure because when I do receive letters from them they don't have the figure I borrowed from them on the statement, just the words "Not known"

    1) I didn't think it was was allowed to add all the interest instantly like that.

    2) They've ignored my verbal and written requests for a CCA( sent recorded deleivery). It's now 35 days. I'm holding out for 30days + 2+12 rule before going further

Can anyone throw any light of if I'm in the right or wrong so far.

Hi there, I'm just after a little bit of help with an Egg loan CCA if possible.

I requested a CCA for both an Egg Loan a/c and a CC a/c. Both were received after about 4 months via Brian Carter Sols (the debts had already been assigned to them). They have now issued CC summons for the loan but not the cc. I think that is because they know the cc is flawed (mine is the same as some others which state "approved limit").

Whilst they supplied the CCA for the loan, they didn't supply any statement of account - should they have done and can I defend the CCJ on this basis?

The agreement also refers to a "Personal Loan Agreement" and various clauses within it - these do not form part of the agreement that they sent me so where are they?? Again does this make it unenforceable?

I have been paying this debt but Brian Carter decided that they wanted 10 monthly installments of £1,400 !:rotfl:
