following hte letters i sent to tesco and tritons they have now replied asking for proff of my surgery via medical letters etc. and are also threatening a charging order against the house/assets. and poss bankruptcy proceedings.
as it wasnt a secured loan i didnt think they could go for a charging order or bankruptcy? I, really scared now. they gave us 72 hours to get in touch with them or they will pass it to the solicitors, we only got the letter today and it was dated 20th feb.
i dont want to ring them but am pertrified they may go after the house, and then charge us legal proceedings which we dont have money to pay for.Please be nice to all moneysavers!

Serious send them anything you have like hospital appointment letters or photo's etc - this at least protects you if they decide court is the best way forward - anything that proves you acted in the best interest at all times will help your fight.....
I'd dig out anything you can find and send a copy to them noting they are being ridiculous.2010 - year of the troll

After some help please!
Have had ongoing issues with obtaining a CCA from HSBC/MCS for a cc dating back to 1997ish.
They weren't able to to supply me with the agreement, just a blank application form, we went back and forth over this for several months, before I referred it to the FOS. They have come back to me to say that mcs have fulfilled their obligations and do not need to send me anything further.
I wasn't sure what to expect from FOS..as we have two similar complaints with them, I assume these are going to go the same way (although one of the other DCA's has given up and passed back to OC).
I am a bit unsure as to what to do next (except wait for the smug response from mcs) - even if they have fulfilled their obligation, is the agreement still unenforceable? Any advice?0 -

The FOS do not have any jurisdiction over unenforceability - they shy from the issue totally.
