Of course she can refuse but all that would happen would be that paternity could not be proven and she would more than likely lose a % of her benefit money (if she is going to be getting any of course, she may be on mat leave and then going back to work)

OP, the form your ex will be sent will ask whether he assumes paternity of the child. If he ticks 'no' then the PWC will be informed that there is a dispuite of paternity and a DNA test will need to be done. Rather than this being a bit of a shock, wI think it would be better for him to delicately broach the subject as it's not pleasant getting a call from the CSA stating there is a disputed parentage.

I also echo shell though....after a one night stand a DNA test is a must. The fact that he had the snip means nothing as he could still have had some live fellas swimming about....;)

Perhaps I didn't word it clear enough. I meant she cannot refuse and still receive child support off of him.

she wouldn't be the first to try though!

an old friend of mine was in exactly the same position and got hammered a few years back, his ex refused 2 blokes the dna test and came to private arrangements with both of them, behind theirs and the benefits agencies backs!

i don't think she ever got caught either.

So if she refuses OP, then all that wil happen is that your ex will not really know of he is the father or not. Which would be a real shame for all concerned. If done via the CSA then if SHE refuses the test, then the case would be closed and no monies owed.

He doesn't have to come out with the 'is it mine?' line, he could more go along the lines of 'look, I know that the baby is mine but since we just has the one night of pash, and I'd like to be on the birth cert (assuming he does), then for my piece of mind I'd like a DNA test done....

I'm looking at it from a woman's point of view and trying to think of a 'decent' way to get round it bearing in mind that her hormones will be all over the place and particularly so when she has had the baby.

He has the right to request a DNA test - provided that if the CSA contact him, he denies paternity within a very short time.

you're very judgemental, considering you have no facts.

this particular pwc was a very sneaky specimen. she played the system well and used the threat of csa involvement to secure private arrangements with 2 separate blokes who had no knowledge of the other. whilst all the while milking the benefits system for thousands.

not a case of more fool them really. more a case of yet another unscrupulous, gold digging pwc.

Am struggling here to comprehend why your 'mate' would ask for a DNA, the female refused it but he still coughed up? As I said...more fool him...if he had doubts then he should have insisted on the CSA route...out of curiosity, how did this happy saga end? If she never got caught then presumably he is still paying CS? Or did for 18 years?

As much as the PWC was in the wrong and extremely conniving ... it is more fool the men IMO. Perhaps it's learning from experience, but if a man has a one night stand or has any inclination his partner may not have been faithful at the time of conception, then he should insist on a DNA test. No DNA test = no child support. That would stop this kind of thing happening. (It wont stop it all together of course as some men are led to believe they are the father when not, in long term relationships)

csa involvement would have meant him forking out a shed load more than she was asking for. simple maths really. not knowing much about the csa, what would you choose??

also, it only came out a few years later that she was fleecing another guy with the same story. that's when it all came to light.

i don't know what or where she is now. the mate in question is died in a motorbike accident a few years back.
