ebay took money from my account without permission!!!!!!!!

:mad:Hi, my daughter has an account with ebay, she lives in her own home and has her own bank account etc, in August this year as she was away on holiday I used my debit card to make a one off payment onto her account, then in September she sold a few items, all which went well but noticed on her account she had been charged twice for the same sale, she queried this with ebay who said thay were looking into it, her bill was for £247,81 and should have been after removing the double charge made by ebay should have been £152.40, she was sent a bill for the full amount stating that she owed the full amount,

she then took advice from the CAB who said she had infact been charged wrongly, so the outcome was she refused to pay her bill until it was sorted, heard nothing back from ebay at this point, on her ebay account it still showed she was beibg told she owed £247.81. Attempted to ring ebay and she was told its being looked into. Then yesterday I went to buy an item using my debit card and it was declined, which was strange so I rang the bank and was told that an amount of £247.81 had been paid as a direct debit payment to ebay, I had not given any authorization to ebay to take this amount or my bank to pay it. I was told by my bank to go to ebay so I rang ebay and was told that th epayment had been made manually on line as it had been before in August (which was when I made a one off payment to my daughters bill,

So I rang the bank who said it was showing up as a Direct debit payment not an online payment, so I rang back ebay, put my daughters account up on screen and was told by the ebay person I was talking to to go to the accounts page and click on it which I did , he then said to look at the part on the page where it shows automatic payment method and see what it said, next to it was the word none,

he said Oh" and said that I must have set my card up using ebay, so I went back to my bank who said if my card had been set up ebay would have took a small amount to prove it was my account and that this had not showed up anywhere on my account,

so back to ebay I went and basically told them they had wrongly took mney from my account and that the only way my card details could have been got by them is when I made a one off payment, at this point he told me he cannot help me and to go to the authorities and hung up,

Sorry for rambling on but basically ebay have stole money from my account, I have checked allthrough my daughters ebay account and the only bank detalils in it are her own, but since she was overcharged she did get her bank to put a stop on any payments going out to ebay until they correct her bill and resend it to her,

yet now I am out of pocket, ebay are refusing to speak to me other than go to the authorites and the bank are just telling me to go to ebay, they are of no help whatsoever, I have made an appoinment to see somone at my bank tomorrow to attempt to get this sorted, any advice on where I stand will be appreciated

Assuming I have understood this then I might be able to see what has happened, possibly.

If you add a card to an existing account where a card has already been registered it stays on that account unless formally removed. It does not need verification as only the first card (if it is still live) needs that.

Therefore, daughter had an account that was verified in her own name and with a card in her name. You added your card to make a payment through your daughter's account and that card was retained as a back up and when the original card was declined paypal went to a back up source.

For a very short while, due to address issues with my son I added my card to his account as a back up and it wasn't until later that i remembered to remove it, my card was never verified by paypal.

It is going to get complicated now as it all relies on whether adding your card to make a payment on someone elses account was correct or not, when I did it I rather assumed I was breaking the rules as although our surnames and addresses were the same I was not the account holder, I never knew whether I should have been allowed to add my card or not.

Your second issue is the double payment, I am susprised CAB gave a decision on that one as surely they are not party to ebay details, why was the original double payment made in the first place? It is probably going to be easier to sort that one out and get that double payment removed if possible. Was the payment a payment for goods or a bill?

Also when CAB said that the bill was wrong how did they advise her to proceed, has she started any formal complaints and investigations against paypal, has she submitted proof that there was an error or did she just refuse to pay?

Paypal are known for their strong arm tactics in recovering unpaid items and will do anything necessary to recover so she needs to tackle that as a matter of urgency as otherwise even if you can get your money back they will just chase your daughter for it.

Hi thanks for the response, I never added my card to my daughters account I just used it to make a one off payment to her bill while she was on holiday, I did check after making the payment and my card details were not added to her account, and was told that when I soke to the bloke at ebay that even though I paid her bill using my card my card details would not have been kept, only if I had added my card to her account would my card be there and it would show up on the accounts page which I checked with the person who I spoke to whilst on the phone, and the only card details on her paypal account are also her own. the extra charges are for her bill where she sold one item but the charge for selling the item was put twice on her statement,

ie Item number ........................ final value fee £34,70
Item number ........................ final value fee £34,70

both item numbers were the same and only one item had been sold this showed up on five more sales, 2 charges of the same for one item sold, as for the CAB, we took a copy of her statement to them and thge sales she had made and it cllearly showed that charges had been made twice, we have sent the bill and sales to ebay to show the error but basically as hey now have technically been paid they did not wish to discuss it further, and on ringing them again they just said that if the bill was wrong then why did you pay it, trying to get through to ebay and get somone who cares is a joke,
  • Sorry to hear about this. They are in the wrong so I would send them a recorded letter explaining the situation and telling them you expect their mistake to be rectified and compensation paid within 14 days or you will go to the small claims court.
Then when they do not sort it out go through the small claims procedure, add more costs for doing this and you will get your money back.
Trying to deal with them by phone is a waste on effort.
Let us know how you get on.

You keep mentioning ebay but it sounds like your actually in dispute with paypal. They are both separate companies. You need to clarify who has made the mistake ebay or paypal so that you are complaining to the correct person.

Hi, went to the bank, still not happy, the bank said that it is showing as a card payment , not a DD as I was told over the phone, and they cant request it back, I have again been told again to ring ebay, ebay attempted to take payment from my account on the 25th Oct but payment was declined, and they again requested it on the 30th, yet this time it was paid, all the bank have done is open a dispute which I was told will take 120 days, as the payment took us over our overdraft limit and our account has been passsed to collections the only person that gave me some advice was the person from the collections dept who they put me on the phone to in branch, and she suggested that if I contact the fraud dept of our bank and give them the details as the payment is in dispute, it will show once they look into it how the payment was requested on from ebay, as the bank say it was a payment using our card but then we have been told that this will show up if this be the case, on an e-mail from ebay it states

    Subject:
Action Required -- Credit/Debit Card Payment Declined
    Received:
    25-Oct-09
    From:
    eBay
    Expires:
    10-Nov-10

    EBay Account ID: xxxxxxxxxxxxx
    Card: VISA XXXX-XXXX-XXXX-xxxxxxx

    Outstanding Payment Due: £247.81

    Hello xxxxxxxxxx,

eBay sent this message to xxxxxxxxxx
Your registered name is included to show this message originated from eBay.

We are writing to alert you that your monthly eBay seller fees have not been paid because credit/debit card declined eBay's attempt to automatically deduct the amount due.

Now what this wording means I have no idea and ebay wouldnt tell me, now if ebay attempted to automaticall deduct money from the account which was mine on the e-mail, then surely no one has made a payment on line using my card which is what the bank are still suggesting, now time to ring the fraud dept to see if they can be of help. And send a letter to ebay

AS well as all that your daughter needs to be sorting out the payment as well, if items were double charged this is a serious glitch and one I do not recall having come across before. It should be fairly easy to get ebay to see the issue.

Kinda similar, I have been double charged for listing fees (before the free 99p listings) twice, on seperate occasions, and each time called ebay, who were able to credit the mistake to my account - failry simple as it would be obvious that the listing numbers were the same. Has she tried to call ebay with this information?
