3 Mobile Broadband-Can I Sue Them?

I had an 18 month contract with 3 for a mobile broadband account (and dongle) but after starting to work in London it was clear that the service did not work in central London due to a lack of bandwidth. I let the contract run for the full 18 months, called 3 to cancel and stopped my direct debit.
I've now found that they have been registering a default against my previous address, and on my Equifax credit file. When I called them today to dispute they advised they have no record of my cancellation instruction (but don't record all their calls) and insist I can give 30 days notice from now, and have to pay another £37 for 3 months of service I didn't have!!!
I have formally asked them to note my account is in dispute but apparently I have to contact the collections agency to do so, and the best that they can offer is for me to write to OTELO and 3 head office to raise a complaint.
Can I take legal action against them to counter the defamation of my character that they have caused through poor administration when I called to cancel and subsequent recording of a credit default?
Any advice or similar experiences appreciated.

3 are notorious for this. The only real way is to cancel in writing, sent Special Delivery, and have a letter returned and kept with your final statement (that I'd be sure to get sent by post for the sake of the £1 charged).
Or, PAC your number to another provider. I'm not sure if you can do that with mobile broadband? Don't see why not. Switch it over to a PAYG SIM and then bin it.

They will agree a settlement with you but wont waiver the charges i'm afraid. Bad Admin on there part and bad judgement on your part as you assumed they would do what you wanted (as would most).
End of the day they dont care about your credit file - none of these companies do unfortunately all we are is £££££ signs....simple as.
(trust me i know) I've currently had a case with Financial Ombudsman - initial complaint logged in April 09 and have had a few letters back - most telling me my case is waiting to be assigned to a dedicated case handler so from my experience i wouldnt even bother complaining to the FO - just try and settle with 3 or there creditors before it goes from being logged to assigned on your credit file.0 -
They haven't defamed your character so you would have no legal recourse.0

i have had problems with 3g since march this year i have never had any coverage in my area when i rang they just kept moving me from one person to another then there was a problem with the radio mast they just kept fobbing me off]then they said they would not take any money for setember they did and for october i emailed them and wrote 2 letters when i told them i wanted to cancel they said there would be a charge of £138 i have decided to stop the direct debit these companies get away with murder they should be regulated and shut down0
