Already claimed once before

Hi there,

First time on the forum but long term listener:T

I am with HSBC and already successfully claimed my charges back before all cases were put on hold.

Trouble is that I have got into fiancial hardship and have incurred more charges over the last year.

I spoke to the collection department to try and put a stop on the charges, but the woman on the end of the phone told me that as i have claimed my charges back before they cannot credit any more charges to my account(s) - I then got into an arguement with her as I was trying to explain that as the charges had not been debited from my account then they would not be refunding my charges they would be stopping the charges.

She would not see my point and when I hung up and then checked my accounnt on line and discovered that she had cancelled ALL my direct debits

I have had to open a new account with a different bank, but my question is that as I am in finanical hardship can I claim my charges back for a second time?

  • Well I'm about to try again, fed up of having to take out payday loans each month to cover bills and living expenses, wish me luck. I prob been charged another £1000 since 2007!

    If you have priority debt arrears(mortgage or rent, council tax, utilities) then i can't see any reason not to.

  • As I've claimed the money back once do you think a phone call to Halifax explaining the whole taking payday loans to pay my bills etc.. plus the multiple charges i get (I usually have at least 1 or 2 a month) would warrant them to look at my account again?

    My gut feeling says no but have you got other credit card/store card or catalogue cards to reclaim.

    got no catalogue cards etc... I have got an old Capital one credit Card which needs paying, and did have late charges there (payment cleared 1 day late!) and then it snowballed after losing house.
  • I've decided to put in a new claim, I just did a quick check on my account and I'm due £85 in charges from tomorrow until the 19th (2 x £35 and 1 x £15 charge) I looked back as far as I could on my online statements and since 12 August to date I've had £350 charges against my account, I dread to look back further.... no wonder I struggl eeach month, i know it's mostly my fault but sheesh! I'm going to ring Halifax and see if I can get these charges coming up dropped!
  • Perservere Insomniac, at the end of the day it is still your money that they have been taking. I am in a holding pattern with hsbc at the moment on my second claim - we will wait and see!

    You need to ask them for the full list of charges and then reclaim the lot. You also need to do this in writing.

    I've put the letter in the post today, I've asked from July 07 as that was when I had claimed too previously... I'll just have to sit it out. :confused:
