A bus hit me!

    shellsuit It happened in the summer, the driver accepted fault and my brother drove off on his merry way. He since has received a letter blaming him for the indecent. He only got a verbal admission of fault from the woman driving the bus.

    Did your brother take any photos of the alleged damage? Or make any notes/diagrams soon after the incident of what happened and any damage caused?

    If he didn't then your case is weaker and the only thing you can do is argue that you want another quote for the damage.

    And verbal admissions of fault with no witnesses present to support your brother, are not worth anything as people can and do change their stories.
    I'm not cynical I'm realistic :p

    No, he did none of what you mentioned. He is a new driver and at the time had been driving for less than one month. He is aliment he was not even moving when the bus hit him at low speed. He has never lied to me before and the fact he said the driver admitted fault makes it sound like he genuinely was not moving, however this is no good in a court of law. If he chooses to do this through his insurance, it looks like they will have him to blame for it. He had no witnesses, although, I personally wouldn't think passengers on a bus would be allowed to be witnesses. What if he had a passenger in his car?

    Your post isn't clearly written, which is the main reason people are having issues with it - it took me three reads to work out what you meant.

    Anyway, from what I can see there are two problems here:
    • If the bus driver admited fault at the time, why didn't your brother notify the insurance to claim for damages off the bus company?
    • The bus driver has two independent witnesses saying the driver was not at fault, so on the face of it they have a good chance of the insurance finding for them, if the insurers are called in.
    The £2,000 figure is probably to replace and spray some bodywork (a panel or something like that). I'm no expert on the cost of repairing buses, but on a car it can cost hundreds of pounds to do that kind of work, so on a bus (which can cost a couple of hundred thousand pounds) it ain't gonna be cheap.

    You may be able to ask them to get a second opinion on the cost of the work and forward the quotes to you, the chances are though they wouldn't be bothered and would just refer it to the insurance, especially if they have witnesses backing them up.

    For two grand, I would put it through the insurance, but that's your call really. I had an incident when I was younger and shunted another car, the cost of the new bumper/respray was about 400 quid which I paid directly and the insurance was never told. I had 3rd party cover and a couple of hundred quid excess, so it was worth doing that way to save on my premiums over the next couple of years. For a couple of grand though I'm not sure he would save that much on insurance, especially if he has another accident when he would lose his no claims and face a price hike anyway.

    You weren't there, there is no written record of the events, you have no knowledge of the legal aspects of the case, your grasp of the English language is nothing spectacular (do you mean adamant?) ... This is what solicitors are for, alternatively let the loss adjuster deal with it. I'd laugh if I worked for the bus company and I received a letter from someone's sister!

  • I may be way off the mark but was your brother insured at the time of the accident? If he was, it seems very odd that they are writing to him directly.

    Forward any correspondence you receive to your brother's insurers. Do not attempt to deal with this yourself.

    I'd definitely let the Inusurance Company deal with this & ask the Insurance Company to check where were these supposed witnesses sitting on the bus who allegedly saw the incident?????? in relation to where the car/bus was damaged.
