Sister wont let me see mams will!!

Hi All
I need some advice, my mother died recently, my sister is the executor of the will but she will not let me see it, what rights do i have. Many Thanks

    Thanks for the advice, i did not know where to post so i looked in the most suitable places so i bow to your superior knowledge

    My understanding is that an executor doesn't have to show anyone the will, unless they are a beneficiary. Once the will has been registered for probate then anyone can get a copy, for a fee. It can take a while for a will to be registered.

    I can't understand a family member not showing another the will? Seems extremely spiteful to me.

    If there is something untoward in the will, then both parties should sit down and discuss.
  • Id be wondering what your sister was trying to hide. Definitely use Debbie42's links and get a copy as soon as it becomes possible.
  • Yes the best way around this if your sister continues to play hardball is to wait until Probate is granted and then request a copy of the will from the Probate Court and I think it costs £8 for a copy of both (Will and Grant of Probate)
    You just have to fill in a simple form detailing the persons full name date of death etc and pay the amount due this can be done at the Probate Court or via the Probate Court. This is detailed on the links already been posted.

    To contest the will then you can apply to the Probate Court BEFORE the Grant is issued BUT usually you need some sort of proof and not just heresay. Once you get the will after the Grant is issued you can then contest the will if there is reason to do so. BUT any claim you make against the estate needs to be done before the 6 month period AFTER the date the Grant is issued.

    If your sister is being difficult it may be worth reminding her that you can see it after probate and challenge it at that time, so that keeping it from you isn't going to stop you from seeing it in the end.

    Remember though it will only go to Probate if the estate is above a certain amount - I can't remember how much that is. Is there a property involved?

    Probate is not needed if the estate is worth less than £5000
