Unenforceability & Template Letters II

Yeah i know
And i know i should keep ignoring them. But my CRA files still dont show defaults (well my NatWest account doesnt show on there at all) and i keep thinking even though they admit unenforceability i should try with a low F+F as long as they agree to account £0 and no defaults been added.
Maybe i could keep a reasonable credit rating still.
I did tell them in the past that i was moving abroad in the New Year!
Your gonna tell me off for this posting, i just know you are
Yep - i'm going to tell you off hahaha
Forget offering a F&F cos this will simply be rebuffed and possibly make them add a default. Think of it this way, no news is good news and if you forget about them they will eventually wear thin of you and stop writing.
However, until the day comes that they do add a default - you stay silent! Why on earth would you make an offer to the OC when we all know they never say yes!
They most definitely will not remove a default - they'd rather lose the money than remove a default!
We've had this same chat twice before mate...... Should I start to get worried about your 'next move'?2010 - year of the troll

Ok mate. Ill keep my silence. Maybe i have just enjoyed challenging them
Ill totally ignore them until i receive any letters, threats or visits. And ill let you tell me how to handle them
Thanks very much again for your help NID.
A few people (i do for one) definately owe you a few beers for all your invaluable help. Ill sort you out Stellas galore next time your in London.0 -
Hello NID,
Invaluable thread, thank you.
I have sent letter no 8 to my credit card people & the response basically ignored my asking for a copy of the default notice and rambled on about the credit agreement copy which they did send me.
I was going to send letter no 9 (formal demand for default notice) but wanted to ask first,
I am still paying off this credit card at minimal monthly payments with interest suspended (this is the arrangement I came to with them when my circumstances changed and I could not make the payments, its then that they defaulted me without my knowledge, i didnt miss a payment)
All I want is the default removed from my credit file.
Sooo.....
Your letter template is for a settled debt, is it ok for me to change it as needed? (the debts not settled)
Am I risking them getting very s***y and slapping interest back on or demanding I pay more than I can per month?
If they did I would threaten to not pay them at all, as the default ruins my credit rating whether I pay it or not, but Im trying to clean up my rating.0 -
I'd not have paid them - especially not when they defaulted you.....
But yes, you can edit the letter as you please. They cannot break the agreement and add interest unless you break the terms of that particular agreement....2010 - year of the troll

Goodtimesahead: Out of interest, when did you actually default that account? i.e. miss 3-6 months of payments.

I don't recall for sure as no history of the account is being recorded on any of my credit files but I reckon I stopped paying them around Dec 2007/Jan 2008 approx
What do you reckon about replying to them or like NID say best ignore them?
Thank you0 -
Can I also just say a massive thankyou to NID.
Your advise is helping many !!!!
The whole process is rather exiting too.....0 -
Morning all:o
Here is a quick question, I did a cca request for my wife MBNA credit card on the 26/10, it included the standard request and also I put a few other choice compliants on it.
Now I had a letter and a statement yesterday, the letter said they where still looking into it and we should have a reply by 22/12 but on the statement it appears the chq for a pound had been applied to the account.
What should I do next, can they put a holding letter in place? Can they use the chq?0 -
They can investigate yes, give them time to sort it out for you. They cannot use the £1 towards the debt. But just wait til they respond before doing anything then compile a list of complaints and move forward at that point.
Don't confuse things now, by writing in. Just let them respond - no doubt you'll have something to say about that response as well....2010 - year of the troll
