There is a bit where i have ticked the box authenticating as my signature and the MBNA Director has ticked a box that says: Above are sections 1-3 of your terms and conditions. The rest of your terms and conditions (i.e.sections 4-16 including definitions), can be viewed by clicking the Terms and conditions link at the top of this page.

Mate I cannot remember everything we discussed. Without having to go back and read 10 pages of repetative posts can you just tell me (to make my life easier) what I last advised? Nothing will have changed since then.....:confused:

Eeeeh, by gum laddy! I'd just send the CCA Dispute letter anyway, can do no harm can it? :rotfl:

    Edit:
Actually, didn't I say that it would be best for you to ignore them? You're now confusing me cos we've sorted you, so why more posts about the same problem? In your case you have to sit back and do nothing - we're not going to have to go over the same ground as last week are we? I hope not....

Yeah basically i am going to ignore them but it always helps if the agreement is unenforceable :D

If i am going to wait 6 years the 6 years and 2 months wont make much difference to me :D

Or maybe i am just beginning to enjoy all this (probably due to having not much else to do).

Although i have 3 days work this week :T

You advised ignoring them for 6 years.

NatWest credit card the have accepted the CCA is lost and not enforceable.

Virgin hassling me but i am ignoring now and probably enforceable.

NatWest bank account at overdraft limit and will be over the limit next statememt
  • No, No, No - it does not have to be signed and dated at this stage as they can send a copy document so please concentrate on what i'm saying. You've more chance of platting fog that winning unenforceability cos it wasn't dated - that is self explanatory and thus I never answered. :D

Fair enough:D. The only reason I asked was because it was a copy of the oringinal doc and not one that that had made up.
  • Thanks, question is though should I go down the unenforecability route? If so what letters should I send off?

Hi NID, I know your a busy person on here and in demand, but any advice what letters I could send off if any? Hoping to get some sent off today.

    Thanks

Ok, well in that case you should be more interested in seeing a copy of the original.... however, you've already had it confirmed in my earlier post that it is not enforceable so the date doesn't matter - that's what I was trying to point out - you already have them, so to speak. One more point doesn't matter (plus it is the smallest point).

Not many courts will award unenforceability (s.127) due to a date being omitted - although on the original it should be there, yes.

Does that answer it for you? The original agreement should have 2 dates and 2 signatures - yours and theirs. If any is missing then it is unenforceable. :D
