Sacked what benefit entitlements do I have.

  • I've never made a claim in my life apart form the DLA that I recieved help with from a local help group when my eyesight deteriorated. Are there any organisations that can guide me through the process as I'm sure that it will be a mine field. Sorry that I seem a little nieve to all of this, but I feel that I need to get up to speed knowlede wise, as I'm sure having been sacked getting back to work may be a struggle.
  • What happened was this;
    I was a middle manager in a call centre. A supervisor that reports to me had agreivance raised against her. She submitted a grossly egsagerated statement to avoid the grievance. Upon questioning she accused me of helping her write the statement. I had been asked to request the statemnent from her by the HR director. I was following her instructions. The HR director later said that she had not asked me to get the statement, as this would have been a breach of company protocol. So basically the implication is that I was involved in the formulation of the statement.
  • I've also worked ther six years. I'm not in a union. I was sacked for gross misconduct.

    So all you did was request a statement? Or are you saying the HR bod requested that you assist the writing of said statement, sorry I'm having trouble understanding exactly what happened.

    Whatever the answer to the above, is this protocol you mentioned documented and when were you made aware of it?
  • Yes, all I did was request the statement. But what this did was allow me to be implicated in it's construction, apparently. The supervisor was facing possible dismissal for the statement as it was disproved by several witness's to the alleged grievance. The protocol that I talk about is the fact that I should not have got involved in the case at all. I only followed a request from the HR director, who shoulkd ahve asked for the staement herself. She is now denying having asked me to obtain it. I do0 however have history with the director, we fell out a couple of years ago about derogitory comments that she made about a disabled employee, our relationship has been tense since.

    From the little info I have I would imagine you have a pretty good case in terms of a sanction.

    Very important - did you know you should not have gotten involved and could you have reasonably refused the management request to obtain the statement?
  • No I didn't know, as I said I was following instruction. Yes I could have refused but I didn't see the possible consequences. At the end of the day I am where I am. I will appeal, but the fact that a director is involved pretty much predetermines the outcome, so my eforts are on finding work. My immediate need is to cover my bills, hence the benefit questions.
  • Could the housing benefit and council tax benefit be sanctioned?

    No, they would not be sanctioned.
