Moss brothers-beware

Hi All
Bought a suit from moss bros for an appointment,tried only the jacket on in Store, took the shop assistants word that the trousers were okay as I did not have time to try trousers on, on putting the suit on the appointment day, a couple of weeks later, found trousers were too short,on closer examination there was extreme wear and tear around the crotch area, consistent with someone wearing them for a considerable length of time, I then took trousers back to the shop last week, first opportunity I could, when taking them back , I explained the situation, I did not have receipt with me ,believing I had lost it,was advised to come back with my bank statement the next day showing payment which I duly did, on presenting this to the SA, he phoned his supervisor, who refused a refund, or exchange, infuriated by this I then took the suit to their head office to be examined by a so called independent examiner, but due to the bank holiday was not resolved till today
they are now refusing to refund or exchange,and they are saying they never sell a suit like that always sell it new,
I disputed this with their head office, and the personal examiner was their customer services manager!!
I have since found the sales receipt as well over the weekend,
I feel whats happened here that the trousers/suit have been returned before, or tried on by members of the public prior to me, which caused the exteme wear and tear and they knowingly or unknowing have sold a worn suit
the guy even remembers serving me the suit!
From what I have read on the trading standard website the article should be fit for wear and tear, obviously here it is not
I quoted this to their customers services manager, who said we shall await any outcome if I go to trading standards
if they just swapped the trousers I would have no qualms, but it has just made my blood boil, all suits I have bought from other shops have never had this problem, and yes I do expect wear and tear from considerable wear over months /years, but not 2 hours !which how long I had the suit on!
Any ideas anyone what to do next

the suit was bought on the 20th of April,and I went back on the 25th of May0 -
Whilst I appreciate your views... looking at it from a stores perspective you had the item for over 1 month and for all they know you could have been wearing it 24/7.

Whilst I appreciate your view astaroth,
I still will be taking it further,as I feel unknowing/knowinly they sold a poor suit, and as for checking items before purchasing, owing to good faith I dont tend examine in detail crotch areas for extreme wear and tear....never had the problem with HOS, Marks and Spencers, John Lewis etc, never had to take a suit back0 -
even wearing a suit every day for a mnth i would expect it to last longer than that. Its the shops duty (and not the manufacturer) to prove that it wasnt faulty at the time of purchase as it has only been a short while since you bought the suit (rather than if you took it back 7mnths later). You are also in your right to ask for a replacement or your money back (and not gift vouchers) instead of a repair. Although if you have agreed to a repair then you cannot cahnge your mind.
As its too short and in a bad state i would not settle until i get a refund, personally.Smile and be happy, things can usually get worse!0 -

I totaly agree, no way even if I had been wearing a suit for four weeks should a suit be like that, but it was only two hours!
thing is ,iI bought a suit from hof a week ago,again did not check the crotch area for extreme wear and tear!
I am thinking of going to trading standards today or at least give them a call
not giving up on this one0 -
Just an update if anyone is interested LOL!
I have been in touch with trading standards and I am perfectly within my rights to demand a refund, plus the cost of another suit which I had to buy for said appointment,plus any financial costs imbursed etc
yep I`m on one,
never give up guys!0
