You can serve at the last known address of the Defendant under Part 6.9 Civil Procedure Rules.
We have no idea what assets the Defendant has. Personally, I would issue and try and enforce.0 -

I know you can.
I'll ask again...who would you name as the defendant?
What's the point of spending £60 issuing papers to try to get £600 back from someone [name uncertain], somewhere [address uncertain] with probably no assets,,,,, when the chances of getting the money are much much greater than 10 to 1 against....?
The OP sent the equivalent of cash in an envelope to someone somewhere....it's gone and it ain't coming back!!!0 -

I would name the individual.
I think we all know that the OP has messed up but what we are trying to do is establish the best way forward from here without continually criticising.0 -

What jameslavers.com???????
You really think that's the blokes real name??
Fraud 101, day 1, lesson 1...if you're a scammer, don't use your real name on your scamming websites - use a made up one instead [it makes it more difficult for people to issue court papers etc].
The best way forward is not to issue papers just coz you've got a name and an address [both unverified]...but to establish the odds of succeeding and then make a rational decision.0 -

Nah, I reckon you would be able to trace him pretty easily. Used to be able to get tracing agents for next to nothing (often on no-find, no fee).
That's what I would do anyway.0 -
Here's a thouight for the OP
google his name, find some networking sites he;'s on and then reg [throwaway email addy?] and PM everyone he knows/is linked to and post on the forums he frequents about the debt.
Also start a website called jameslavers-is-a-scammer
Tell him beofre you start doing this so that he has a chance to pay up...or else!!!
Long shot, but low cost and might be worth a try??0 -
No apology offered.
OP says he has the address. Its not on website, but if OP has address he can effect service there.
that site just has my warning bells going lol
and the address is on the site
the contact me link at the bottom?
anyways ive spent the better part of half an hour searching for infor on the guy and the company behind the website if their is one
a domain search showed it is indeed registered to him, and hosted by 1and1
the address and details are the same so it looks to be accurate, and it is his name, as for a company, i cant find one
so yeh, write a letter before action to the address stating your intent to sue then do it if he doesn't replyBack by no demand whatsoever.0
