I bought an item and it didn't work despite being described as near mint or words to similar effect. Returned it and asked for a refund. Seller informs me that he stated no returns (I checked, he did) and that ebay have informed him that he does not need to refund me.
Cost me best part of £100, paid by paypal.
Where do I stand, never had a problem buying before.

If something is faulty or not as described his no return policy is useless.

If it is a business seller they have to accept returns. A private seller doesn't. Did you return the item before speaking to the seller? If so thats rather presumptuous isnt it. I hope you sent it tracked otherwise if you do try a paypal claim you will fail as you wont be able to prove you returned it.0

This is only part right if the listing was an auction, with auction format listings the seller, whether private or business seller, does not need to accept returns even for faulty items the item only has to be what the seller said it was i.e if he says he's selling a beach ball be must provide a beach ball and not a football, if the beach ball arrives but it has a puncture in it then he still doesn't have to refund you.

sure ebay are a law unto themselves i was just pointing out the fact that strictly speaking this seller can do what he is doing if he auctioned the goods, by all means try and get paypal to get your money back op but just know where you stand before you go shouting the odds or making demands as you might not have such a strong case to argue unless paypal support your claim.

As with your comments on the other thread on Paypal it shows your poor understanding of it. You say who cares about paypals rules well here is a prime example how knowing how paypal works can get you a refund. Simples eh

I fear you do misunderstand paypal when it is used with ebay and that does leave a buyer or a seller vulnerable. Regardless of laws, acts or statutes paypal WILL consider claims for item not as described as long as the purchase was through ebay.
