If you don't intend to drive within the next few months and your driving licence expires, do you really need to renew the licence?

Could the licence be 'renewed' at a later date?

I have just been in a car accident that was not my fault (a woman drive into the back of my beloved little car). When I spoke tot he DVLA when I was renting a hire car (as part of my insurance policy) they were fine about the fact that my licence was out of date, and I promised to get it renewed as soon as the claim was sorted out, and the renewal is sitting waiting to be sent off).

HOWEVER my insurance company are kicking up a fuss and the underwriter (I'm assuming from the other company as they are the one being asked to pay) is saying that they may not pay up as my licence is out of date.

This is my own fault for not renewing it earlier (busy life moving half way across the country etc etc) but I did not think it was going to cause this much of a problem.

Is the insurance company right to do this? I have a feeling they can do anything they like to get out of a claim and this is a perfect excuse. Please just renew and don't have the problems I have had.
