    Apologies, i shouldn't have inferred landlords/letting agents are professionals.
    It's basic professionalism to pay money when it is due/assured, like I've paid 4 years worth of monthly rent on time (without the need for being reminded) as requested and am waiting for ONE payment back later than when it was assured.
    I know our rent hasn't gone on Gas certification, this has been absent for several months now (do you think I should report him?? Or are this something else I should cut him some slack on? It's only CO afterall).

    You did the right thing by following procedure, giving one months notice etc. However I *believe* the landlord has up to 28 days to return the deposit, and as you only moved out on the 3rd he still has a week or so. It is perfectly normal for the letting agents to hold the deposit, as was the case with the 2 properties I rented. I found it diud takes some time, and some nagging if I'm honest, to get the deposits back, but I had them both back, in full.

    So what I am trying to say is, you have followed the rules, so give the landlord time to reimburse you. You may well yet end up having to take him to court, but be patient, it sounds positive if the letting agent say they will reimburse you if you hear nothing from the landlord in a week. Hope everything works out :D

    Thanks for your views, I'm pretty much going to take the approach you suggest and will see how things unfold this week as I'm putting a call in to the letting agent on Tuesday.

    as i have already said prior to Deposit Protection - there was NO TIMESCALE for returning deposits... as others have said ... the agent needs time to liasise with the LL

    was an inventory signed on move in and on move out ?

    I don't think I could have moved in if I'd not signed their contract. Doesn't sound very fairly regulated if there is no timescale for returning deposits, why would they say 1 week? Come on, I gave them over the one month notice, all it takes is a phone call, check the flat (apparently he did this) and now he won't return the calls. How much time do these 'professionals' need? I was an amateur tenant, I could raise my funds for 4 years every month without delay.
    As long as it's all legal?? Doesn't matter if it's honest does it.

    Yes, an inventory was signed (i took photo's 4 years ago too), not been given the opportunity to sign anything on the way out (but have photo's too).

    Any views on the lack of a Gas Certificate?

    you rented BEFORE the tenancy deposit laws came into force... therefore there is NO LEGAL TIMEFRAME within which you landlord has to return your deposit

    IF there are repairs issues, then the inventory person talks to the agent, who talks to the landlord, who contacts workmen to visit the property to assess the repairs, workmen then prepare quotes, send those to the landlord, who talks to the agent , who talks to you

    all this takes time.........

    stop being so angry at everything .........

    your landlord MAY be a conman.. you just dont know yet ..... you are speculating...

    There's no regulation (in my situation). As it's me we are talking about me, there's no regulation (as no time frame could be redefined as an infinite period of time which is probably longer than I would live and therefore be impractical when it comes to getting my hands on my deposit). But that's fair because the legal obligation doesn't cover me.

    You're not by any chance my landlord are you?

    I'm not angry at everything, just ignorant landlords. You know, the ones who ignore being honest with you in the first instance when you report something, ignore calls that don't allow a letting agency to fulfil their target dates (ie getting my deposit back within 7 days, probably just some rubbish they told me to keep me happy, yes, yes, not in writing I know), ignore the fact that there is NOTHING wrong with the property I handed back (therefore should be no need for delay), ignore contractual issues like basic hot water for over 3 weeks. Trust me, MY landlord was (and I am sure still is) an !!!!! A conman? Speculating?? I'd be daft not to think otherwise
  • I guess the lack of Gas Certificate doesn'y make him a conman.
  • Not necessarily, but it might make him forgetful, uninformed or an idiot with homicidal tendencies. Anyway, it's too late for speculation. The time has passed as you're not his tenant any longer. If you were than concerned about lack of a Gas Safety Cert you should have followed it up while you were still the tenant
