Good point about them holding his funds, didn't think of it this way.
Yes, we paid the last months rent, gave a months notice (this all happened around mid december and we moved out physically on the 3rd Feb, this was the original dilemma I had because I thought I'd find myself in this position.
Not seen the check out inventory. We suspect he's ditching the letting agent. One of the other residents in the flat seemd to think he was 'a bit of a funny !!!!!!'. seems they are right.
Anyhow, I intend to potentially use the courts but I think the letting agent will pay. Legalities aside, I have the landlords address and am tempted to go knocking and give him a few of my views face to face. where we go from their would be based on his response.0 -
I would try and dissuade you from approaching the landlord at their address and just deal with it formally. No-one wants a charge of harassment or intimidation on their record!0

The correct procedire is not ring the letting agents when you have a spare minute at work, then take the landlord to court! Write a recorded delivery letter to the person responsible for returning your deposit, i.e. the landlord. It's not even been three weeks, if your deposit was in a scheme, your landlord would have one month to respond. Take a chill pill.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

Thanks for the advice. We started renting just before the tenancy deposit protection scheme was introduced unfortunately.
In all likelyhood, i will deal with this formally, it's just unfortunate that this seemingly unregulated profession treats people like me and my wife this way. We've paid our rent on time for 4 years, we've not complained about many deficiencies with the flat, we even give more notice to make life easier in filling our flat when we leave. then we don't get our money back in accordance with their rules.
As a young first time buyer, we need that money now and it frustrates me.0 -

There are more than 200 Acts of Parliament and regulations covering Landlord and tenant matters - how many more do you want ?

prior to the Tenancy Deposit legislation - there were no rules or set time frames for retrurning deposits
please dont tar all landlords with the same brush because yours is not immediately jumping up and down to suit you....
as others have said... you have not followed the correct procedure anyway - write a recorded delivery to the landlord...... if you still get no response then you can write a Letter Before Action0 -

It's patently not an unregulated profession at all and it's only the one landlord hanging on to your deposit and that's not seriously overdue either. It seems that you are determined to find a problem when there might not even be one yet. Have a little patience.0 -

Who's said anything anything about tarring all landlords with the same brush? If anything, you are only confirming to me that more than one landlord (I was only referring to my own idiot of a landlord) is arrogant enough to believe they can get away with treating tenants unfairly. Seems like someones pointed the tar brush at you well before I could have done.
When i am told i will be paid by a certain date, i expect to be. when it's over a week late and i have to chase it up and get asked for more time, i would hardly say I was asking anyone to jump up and down immediately for me.
i've been plenty patient with the letting agency and landlord and I've always paid on time. it bugs me when this is not recipricated for the one occasion when money is not due back. Do you not think I don't need this money back after just buying a house? After all, it's not like the landlord is short of money, I've given him over 20K in the last 4 years.0 -
Just out of interest - if you didn't sign an inventory when you move into a house (and didn't take photos), is there any way the landlord can withold some of your deposit?

of this is not saying that the entire profession of landlords treats tenants poorly i dont know what it IS saying.....

the vast majority of this will probably have gone on mortgage payments, insurance, gas inspections and the like......
the letting agent has said that he needs a week to sort this out.. what is wrong with that - its not as if he is ignoring you - he is chasing things up as best he can ?

You did the right thing by following procedure, giving one months notice etc. However I *believe* the landlord has up to 28 days to return the deposit, and as you only moved out on the 3rd he still has a week or so. It is perfectly normal for the letting agents to hold the deposit, as was the case with the 2 properties I rented. I found it diud takes some time, and some nagging if I'm honest, to get the deposits back, but I had them both back, in full.
So what I am trying to say is, you have followed the rules, so give the landlord time to reimburse you. You may well yet end up having to take him to court, but be patient, it sounds positive if the letting agent say they will reimburse you if you hear nothing from the landlord in a week. Hope everything works out
