Advice re tree/boundary please!

    Try and get a tree preservation order put on the tree - then only a qualified arboriculturalist (sp?) can prune it.

  • Hi all .. right .. an update! Having gone from pillar to post, that is! *L*

    Anyway, you don't automatically go to Land Registry (you've another avenue to go down first!) .. you have to contact your local council, giving them all the details, your name, address and all the info you think they need. You can phone up ANYWHERE in the country asking about ANY land ownership on this number: 0845 850 6506.

    They will then do a totally free search for you (they call it "an action") and whilst they cannot tell you directly who owns the land, they will be able to tell you if it is council owned (there are a number of possibilities apparently ... it could be no-man's land, council owned, or owned by the developer of the estate from years gone by ... then of course, it could be mine or the prat who lives in the bungalow at the bottom of the banking).

    Anyway, as I say, they can tell me if it is council owned. If it is registered as being the developer's land, no matter how many years ago it was registered, the council will then track down the developer OR any descendants of the developer and see what they want to do .. obviously a small area of land less than a metre wide at the top of a sheer drop isn't going to be good building land!! ..

    If, however, the land isn't registered to the developer or council owned, I then need to go to the Land Registry, where I download a SIM Public Guide form 1 from their website. I have to fill that form in and attach any photos, descriptions, a diagram of the land and measurements however approximate, to enable them to get a good understanding of it all.

    Paying £5 by postal order, they will then complete a search on my behalf and will see who it is registered to.

    It will take about 7 or 8 days for the council to look into the free search action for me, so they said they should have an answer for me if I phone on 10th November. Fingers crossed.

    That is in England - slightly different in Scotland & more costly.

    Thanks Yorkiepud; your info is useful to know, so I've already pasted it into a Word document for future reference.:D

    I'm not exactly short of land, but there's a roadside I want to know about and gain some control over, though I already do, in the sense that I have to cut & maintain it.

    Let's hope you get the answers you want.
