    On 1.9 diesels inlet manifold swirl flap failures becoming quite a common problem by September 2009, on top of all the other 1.9 diesel problems.
  • As I say Harvey, I'm convinced it might not be the car for me!!

    My main issue is that I've signed to buy one and worried about the legal standing of that signature. Sounds like I may be able to get out of it, but if there is a possibility they could come after me I'd be quite worried.
  • Harvey, thanks very much for the advice, especially as you're a dealer.

    It needed a new gear link cable or something along those lines. They rang me on Wednesday when I was at work, explained it needed the work, that they were going to cancel the sale but in a 'goodwill act' would pay for the work (apparently £700 worth). I rang today to see if I could pick up the car and it still isn't ready. I just don't have a good feeling about it.

    I know full well that I'm really going to p@ss them off, especially as they've paid for this work but, as I say, I just don't have a good feeling. I have absolutely no probs with them keeping my £100, I just don't want to be pursued for any money.

    That wording to me sounded like they could come after me for the remainder Harvey, is that not the case in your eyes?

    So they agree to pay you £700. Then they find £700 of problems with your car.

    Hmmm, what's that smell?

    gear linkage cable at 700 quid!!! i know it a main dealer part but whats it made of gold, titanium is it a special one that has to be made to order with diamonds on it! sounds as if they dont want to give you £700.

    this is a saab 1.9 TDigearlinkage arm with no cable but the cable is simply a cable like on a mountain bike for the brakes but little thicker.
    there must be other worrieing damage on it saabs are built like tanks but the suspension and engine parts suffer coz theyre heavy vehicle's.

  • Just to be clear, they don't want any more money from me. I signed the deal last weekend and then they found problems with the car they were going to sell me. They are fixing it and the deal would go ahead on exactly the same terms I signed for.

    I really appreciate the advice about it maybe not being the car for me and how much gear links cost, but I really just need to know whether, legally, they can chase me for more than my deposit if I back out of this deal.

    As I understand it when you pay a deposit for a car you are entering an agreement to buy. If you decide to pull out then you lose your deposit.
    Since the OP didn't cancel the deal, the dealer did, I'd have thought that the deposit would be paid back without hesitation.

    I don't think the clause you quoted is right for this particular circumstance. Is there a clause for where the dealer cancels the sale? The clause you quoted is more along the lines of "if the buyer fails to turn up to buy the car as agreed then the deposit is kept" I doubt VERY much there would be any additional expenses for a dealer in the space of two weeks.

    And to offer you £700, then mysteriously quote the EXACT amount for alleged work needing done on your car....I smell the same stuff as PewPew......not pleasant stuff.

    I offer to part ex my car for one of their's that is worth less, they offer me their car plus £700 and I'm happy with this. Arrange to pick it up in a couple of days and give them my car.

    They ring up, say that there will be a week's delay on the car because there is a load of work that needs doing on it. They don't want to charge me ANYTHING, the deal remains the same.

    The car dealership haven't really done anything wrong here, they are currently fixing the car at their expense so I can swap it for mine and they still give me the £700.

    I now want to pull out of said deal and want to know, legally, if they can come after me for more than my deposit (I think they are quite entitled to keep my deposit)?

    ahh...now I get it....thanks for clearing it up.

    In that case I'd expect the dealer could chase you for any money spent on your car if you want to cancel the deal and get your old car back.
    I'd imagine you'd probably be liable for any repairs/parts ordered/time spent on your car...but the total bill would be reduced by £100...the amount you've already paid.

    But I'd have thought you'd get any work needing done a lot cheaper at a small independent garage so the cost of repairs may not necessarily be the £700 they're quoting.

  • Oh god, I hope they don't. I'm going to state that I signed for a car that worked and all this required work worries me. Hopefully they won't sue me.
