next directory unwanted and charged for

Hi all
My girlfriend just received an invoice from Next Directory for £3.75 for a Directory that she did receive. I was in and signed for it when the courier driver lugged the massive thing to our door. We dont shop at Next but assumed it was something they were sending out for free so signed for it.
She never ordered it and never even looked at it. It went straight into the recycling along with all the other junk mail we receive. We dont even shop at Next.
So imagine our horror to get a bill for said directory!!
She has sent them an email through the Next website and is waiting on a reply, but how the heck can they do this?? Is it legal?
They say they have setup a Next account and for her and she will receive another catalogue in January for a further £3.75.

Probably has bought something from the website and not read the t&cs properly which will probably tell all about the automatic sending and charging of catalogues. probably also not ticked a box telling them she did not require it.make the most of it, we are only here for the weekend.

Yes, it is legal. The bits of your post I have highlighted show that she did sign to say she wanted a catalogue - but didn't read the small print.
Call Next and ask them (nicely) to close the account and waive the charge. If they refuse, pay the £3.75 and consider it a lesson learned.0 -

i have a next account and on my first order chose free del rather than pay for the directory as i can just look online
then i had a letter through to say that they were due to deliver the new next cat and if i did not require one ring up on a free number with your cusomer self service number and you will not get a cat
i did this but still received the cat
so i sent them an email questioning this and received a reply saying my account will be recredited and i could keep the cat as a good will (it was already in the bin)
i still have not been recredited for it and have since received the another cat :rolleyes:
i have not signed for either of them they were both left outside my door0 -
I received a catalogue and bill which I didn't order. I called them and they immediately cancelled the invoice and I've never had another catalogue.:j30/7/10:j

I too opened a next account and get the catalogues delivered. After a few i decided i didnt want to recieve them anymore and emailed asking that they stop sending me them as i do most shopping online. Got reply saying ok and i recieved another one a week or two ago! Grrrr
The letter that came with the catalogue said its free unless i order out of it. But i order from browsing online but no doubt will still get charged as they dont distinguish between online browsing and the catalogue for somebody who has been sent one!?0 -

I'd recommend your girlfriend also checks her credit record as when I registered on the next website they checked my credit report and gave me a credit account with a £600 limit. I didn't find out until 9 months later as they didn't send any paperwork with it. Taught me to always read the T&C more carefully.0 -
I would have thought that if the girlfriend "ordered" a catalogue then as part of the order process it would have to be made clear that a charge is being incurred. I know some companies try and "trick" people into accepting things by sneaky methods like "tick box if you don't want our £3.75 catalogue" but I wonder if someone were to challenge this in court (not that they would risk going to court for only £3.75) whether the charge would be upheld.0

Viktory - I see the bits you have highlighted. Do you mean that by me signing for the catalogue at the door, even though it was not requested, I agreed to the terms and conditions for her? The guy just passed over an electronic pad to sign, no paper work, no terms and conditions were presented.
Let me just make clear that she has NEVER ordered anything from next or filled in her details with them at all and certainly never opened an account with them.
she emailed them to cancel it and ask who had given her details but they were unable to tell her. Although they have cancelled the charge.
Ivory Tinker - That is exactly what we want to know. We have asked family members and friends but none of them set it up.
We thought that maybe they had an offer on - the sort of thing where if you give someone elses details you get a voucher or something, but not the case.0 -

Nope, never gives her details out.
I think it is apparent from this thread that this doesn't happen often and somehow they have acquired her details.
Doesnt appear to be a common occurrence which was my major concern.
