Help i am needing some advice please.
We bought a new car at the begining of the month was the demonstrator car so 3 months old and had to wait a 6 weeks after deposit before we got it.
I was Part excanging my car but ended up selling it 3 weeks before for more money which i informed the dealer about and confirmed it twice again on the day of the transaction.
yesterday they have called me 2 & 1/2 weeks after the purchase to say they think that there was a mistake and the amount they charged me still included the part exchange so i now owe them another £1600 for there misake.
I do not know what to do i do not now have another £1600 at the time we paid some in cash and the rest on HP and credit card which was 0% but we do not have the 0% anymore and and can not afford to take out another loan if they are right and we still do owe it which is what it does look like.
help where do i stand in this?

Is the deal concluded? i.e. You've taken delivery of the car and he's taken the money from you and your other car and everything as far as you are concerned is completely finished with?
Also did they give you a receipt for the amount you paid etc.
If all this is the case then it's his fault and the sale is complete and final and there's no legal redress for him.
If the contract is yet to be concluded there is wiggle room.0 -
First things first...
They think they've made a mistake.
Well have they made a mistake or not?
They seem unsure, and you too appear unsure by saying "if they are right".0 -
I do not think the trader has any right to ask for more money as you had already explained to them that you were amending the terms of the contract in advance and at the time, they did not make any counter amendments about the money that they were owed. therefore, the amended contract remians in place and you should stick to your guns and not give any extra money to the dealer.:beer:ASHCHIPS54:beer:

I watched a programme on BBC3 the other night, a guy went to buy an MP3 player and he paid, walked out of shop, the cost was £17.50, they then went after him saying that it was the wrong price and they couldn't sell it to him but the deal is concluded when the cash changes hands, they accepted payment so they can't turn around and then charge you more for it. I would go to Trading Standards and see what they say, Consumer Direct etc. Not an expert but somethings a big off about this. They screwed up, tough.

they are saying they can not find the money for the what would of been part exchange and then blaming one of there colluges that delt with us and took the money.
we had not realised there was any discrepancy probbaly over excited about getting my new car and we had already been over the details with the 1st guy the 2nd guy showed me the car again and took he money. i had spoke to the 2nd guy over phone several days before to confirm the p/e car had been sold so we were no longer needing the p/e. and this was confirmed to both guys at the time the deal went through again. the 2nd guy even said ok so we are not needing the part exchange now while doing the paper work.
now they are blaming the 2nd guy and wanted us to check our paper work as they cant find the money and want me call back which i have not yet as it does look like they have mucked up and my invoice looks like it sayabout a p/e stillStill TryingGrocery challenge July 2016

Let me get this straight, you originally agreed a price on this car which included cash and the part-exchange of your vehicle. So far you've paid them the original cash part but you've taken the p/e off the table as you sold it privately. Can we assume you've now made up the rest of the price with a further cash payment and the dealer is asking a further £1600 on top of this second amount.
Some figures would be nice.0 -
You have agreed a price.
car part exchange + cash = cost for your new car
you sell your part exchange car so you pocket this cash
they sell you the car but you dont think something is missing being your what £1600 better of as you aint given them a part exchange car cause you have already got the cash....
Im sorry but through the excitement of buying a new car i damn sure anyone i know is going to notice the fact that there is an error.
I think from how you have explained it they have made a mistake for sure but you are due them the cash....... im sure someone else will come along and advise you from their vast knowledge how you can dodge or try get out of this,0 -
This a very garbled thread. OP did you 'make up' the part exchange price after you sold the car. To be honest you've 'done a deal' with the dealer and then moved the goalposts by selling the car...if I understand you correctly?0

OP done the deal but informed them they no longer wanted the PX before they took hold of new car
Now if the dealer still though the PX was on why did they not ask where OPs car thats was part of PX on day they took hold of new car?If you dont like me remember its mind over matter, I dont mind and you dont matter0
