upgrade returns need help please

Hi all I'm with O2 thru CPW and upgraded last thurs to Nokia N96 but the phone is rubbish it lags and battery is useless compared to my N95 8gb can i return it and get N86 what are my rights? i'm getting conflicting reports. Just want to know where i stand before i ring them. Thanks in advance

Depends if you bought it instore or over the phone/web.
If bought instore then there is no cooling off period.0
