Car fraud

My query is with 'Evans Halshaw,' car company based in Newport. Their website www.evanshalshaw.co.uk featured a black kia picanto glamour for £2419, which was a good price so after speaking to the Leanne on the phone, I gave a £200 deposit using my credit card. The car was going to be transported from their other branch in Leeds. A problem arose when they said they were now refusing to transport the car and sell it to me for the advertised price. There had been an apparent error and the car was meant to be for sale for £3419. Now i dont know where i stand, i obviously have paid a deposit and want this car at the original agreed price. I have proof of the original internet price, which i printed from their website. (they have since changed the price.)
What are my rights and what can i say to them? This is not fair treatment.

    How much effort do you want to put into this.

    Did they take the deposit? If no then I don't think you have a leg to stand on (he said, she said).

    I assume when you were chatting she was doing all the necessary things to do with arranging delivery etc. ie She saw the price and confirmed it etc.

    I'm pretty sure you have a case, but you will be best talking to a solicitor or going down small claims (if it was a private person I would say don't waste your time). See other thread today on subject.

    BUT it will require stamina, hard work, and a bit of money.

    Hopefully someone better qualified will be along soon.

    Edit I would change the title of your post. It is hardly Fraud and you will get flamed for that.

    I have proof of initial online price, its changed now. I printed it out.

    its a trade place, i could take them to court, would they let it get that far? I work for a newspaper so could get them dragged through bad advertising.

    Id like to do it verbally but im not very strong on that front.

    Did they physically take the money? You need to check that. If not I would argue that there is no contract and you can forget it.

  • If they've made a genuine mistake about the price, as opposed to deliberately misleading you, then you have no legal recourse.

    We bought a car from Evans Halshaw. When we drove to collect it (over 100 miles) the person we collected it from said that the price was a mistake and we'd got a really good deal but they were honouring it. We bought it via the Internet.

    We had no problem.

    However, my parents bought a car via an online advert and printed out the details. Some of the features were missing on the car after they bought it and Ford said that the salesman wasn't au fait with the computer system and so had made an error in the listing and they would not be doing anything :(

    Press on his name and see what messages he's sent to this forum TODAY! Either he is employed as he says and has much time on his hands , or, as I am sure he's a fraud himself.

    Under section 21 of the Solicitors Act 1974, it is a criminal offence to pretend to be a solicitor.
