Cold call from no win no fee company

I wonder if anyone has come across this before. We received a cold call from Accident Assistance on Wednesday. Our car was written off on the motorway nearly 2 years ago and we both suffered abdominal pain and general aches for about a week after, but there was no need to visit the Dr. We didn't have whiplash.

We had all singing all dancing insurance with legal protection. I asked the solicitor at the time if we could claim and her reponse was not unless we went to a Dr - I also asked about mental trauma as I still struggle in queues of traffic, I was told no.

As I said we had a call out of the blue form this company that we have never dealt with saying the other parties insurance had set aside some monies for injury and we didn't need to have gone to the Dr as long as we had self - medicated - which we did with ibuprofen.

Is this legit? I am also concerned that my ex directory phone number is being given out.

    I get contacted almost every day telling me I've won the Spanish Lottery or my long lost Aunt in Outer Mongolia has died leaving me millions and I just need to apply ... oh and send them some money to cover their admin cost.

    I wonder why I never get the money? I even tell them to deduct 10%, even 30%, to cover their costs and to buy themselves a drink ... but the money never seems to arrive :rolleyes:

    If they are authorised by the Ministry of Justice to carry out accident management business (which they are), then they should not be cold calling.

  • Sarahg thanks for the link - the difference between myself and others is we actually did have an accident and they quoted the other parties name. Is this from the database of written off vehicles?

    I don't see how they would find you from that. They would realistically only find the claim by searching on the vehicle. Not by searching the database generally, if you understand me?

    I can only imagine that someone has referred your claim to them - probably someone within the insurance company (very naughty) or possibly the repairing garage, on the basis that they would get some commission.

    If so, fine, but research their profile before commiting. If not give them the big heaveho, ;), ;)

    No win no fee is a good way to go provided you tie them down and actually KNOW what the fee will be if you win.

    Far better "all expences will be claimed from the other side". You need to know what are and where your liabilities lie.

  • Sarah - no repairing garage - totalled completely!!! really do have concerns about where they got our phone number and the name of the other party. It is nearly 2 years ago as well.
  • As said above, cold calling is a breach of their rules.

    I'd avoid any company which doesn't even want to play by the rules they are supposed to as, even if that is a minor breach, they'll be more likely to commit major breaches which might cause you problems.

    I am sorry to hear you have not yet received your monies from your aunties account, I have looked into this personally and have noticed your check had been lost, presume to have have been eaten by your aunts pet alligator which still resides at our head office. Please forward a new check to me personally and i will release your funds at our earliest convenience. Will you be taking charge of the alligator? If not i will add $10,000 to the money owed to yourself and i will sell it on later. We think your check may have given it constipation.

  • I was called by a company yesterday. I did have an accident, so it seemed relevent. However, as I used to be a police officer I am well aware of scams. I gave him scant details of my accident in my local town. I wasn't injured, but he said Insurance Companies retain a pot of money from the fault driver & keep it if it's not claimed. He said I could claim it even if I took headache pills just after the event (which I had as the shock gave me a raging headache & high blood pressure as I had an appt with my GP shortly after).

    I was a travelling home with my Husband (he was driving) at the time. I could do with a bit of dosh, but was suspicious. He said he'd ring me back in an hour & I found the details of my accident. I was more suspicious as the callers number was witheld. He rang back, again witheld, so I didn't answer it. Then he rang me back with a landline. I now have a Manchester number, surprise surprise--it doesn't accept inward calls & doesn't give a company name. I also have a text number, so I'm going to contact the MOJ with those numbers.

    The gentleman calling was Asian & he soon cut me off when I told him my accident was over 3 years ago. I've still had a text since & I've replied to put a stop to them coming in.

    I have no idea how they got my number as I didn't give it to my insurance, just my home & work number. I think they just got it from the register as I didn't TPS my number, but I will now.

    I hate being cold called by anyone, either by phone, email or caller. I like my privacy & don't take kindly to anyone invading it.
