Posted a few times on here about my ongoing case with the criminal compliance team with csa
Got a call from case worker today, she has sent my file off the the fiscal to get a date for court, yay!!! But she said it could be several months before the hearing, that I dont mind as long as I know it will eventually happen!
She said if NRP doesnt show up a warrent for his arrest gets put in place and will be put in a cell overnight for a hearing the following morning.
If he does show up he has to say whether he is guilty or non guilty of lying to the csa and not co-operating and giving correct information.
He will be charged/fined and also a payment schedule put in place if he pleads guilty.
However, I asked what would happen if he pleads not guilty and she said its up to the judge to decide what would happen next.
So, if he does plead not guilty, which he probably will knowing what he is like. What would happen then?

the judge would look at the facts of the case and make his own decision. there is no right or wrong answer here but if they write off any old debt (which i understand doesn't really happen very easily in most cases) then a new plan would be put in place depending on current circs.

The Court will also look at what he can afford and not some mythical figuer that the CSA has pulled out of thin air! Also remember that if he is given a prison term to serve then in all probability you wont get anything as he wont be earning anything. As for him lieing that is for the CSA to prove, and from their past conduct they have no standing in this as they have lied in Court to my knowledge and then admitted it later, so they need to put their own house in order first to comply with the law in that respect.0

Thank you, yes the CSA has evidence of everything he is lying about or denying.
Was just quering what would happen of he pleaded not guilty, hopefully judge will see right through him.
if he went to jail it wouldn't bother me as such, iv had no money for 6 years so going a bit longer with no maintenance won't be a problem LOL0 -
If he lies to the Court and this is proved the case will be sent toteh DDP and they will take it to a Crown Court. If that is proved there and it is the Police that will take it there, he will get years and not just 30 days or what ever the CSA will get for non payment. I think the last hight profile case the guy got and served 2 years!0

He won't go to prison for lying - it won't go to crown. He will get a fine of up to £1000 which will go to Government coffers. In respect of the arrears owed, that will be dealt with a as a separate matter and he could go to prison if he is deemed to be non-compliant ie delberately refusing to pay.0

He is deliberatly refusing to pay! He claims to CSA he has no money, yet he has a house, goes on lots of holidays abroad, fancy cars etc! And the csa has proof of this but everytime they ask him about it he point blank denys everything. My case worker has even seen him driving one of these cars he claims he knows nothing about!!
Jail or fines dont bother me, nor does getting the money tbh. Im past caring about the money, although dont get me wrong it would be nice to eventually get something! I just dont want him getting away with this any longer! He thinks he has won and brags to his friends about how he gets away without paying towards his son that he doesnt want and even tells everyone he doesnt see why I should get his money when I have money of my own. His money means nothing to me, Iv survived this long and gave my son a great life but its the principle!!
I just want to be able to know that at the end of this all, he is not getting away with disowning his son the way he does and not contributing at all towards him0 -
Sorry, but if you lie in Court it is called Perjury, that is a criminal offence and will be delt with outside of what the CSA may do. That part of the case will then be sent to the DPP. Judges taks a very bad view of people that don't tell the truth, as the CSA are about to find out!0

You are correct, a TV presenter recently got locked up for similar a couple of months back.0
