Windows 7 pre order not arrived

I ordered 2 copies of Windows 7 in August from John Lewis on pre order at £49.95 each. They should have been available to pick up on 22 October but to date they still have not arrived. John lewis claim to have no stock of the full (not upgrade) version of Windows 7 and cannot state when they will have. They are offering a refund but at current pricing it will cost me an extra £100 to purchase from say, PC world.

I do not feel I should have to lose out financially but I want to get hold of this software now and not have to wait weeks for it to arrive at John Lewis when their competitors have shelves full of it. To add insult to injury they have had my money for 2 months! If anyone can advise me of the best way to sort this I would be most grateful.

    Had your money for 2 weeks? Someone must have messed up, because JL don't take payment until something is actually in stock.

    If it's any consolation, I'm staff and my preorder hasn't arrived either, despite me being the first person in the branch to preorder it.

    It seems to be people who ordered 2 copies who haven't got the preorders in yet. If the competitors have shelves full of dummy boxes, they may not have actual stock available...it just looks nice to have a wall full of dummy boxes.

    You'll have to decide whether you want to wait and pay less or buy now and pay more.

    Hard to see what you expect JL to do about it, other than refund your money, which they have offered.

    Trust me competitors have stock of it.

    You have two options:

    1) Wait for JL stock to arrive.

    2) Accept the refund and pay more elsewhere.

    Are you thinking they made a mistake with the pre-order price and are now claiming to have no stock?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    No mistake, It was an order done in August subsidised by Microsoft. That pricing is not available now but why should I lose out If they cannot deliver? They are surely in breach of contract. I could have got same offer elsewhere back then but went with JL.

    It's down to Microsoft, not JL. They said at the time that offer was launched that stocks were limited.

    Or take the refund and download it. But that would be illegal... :eek:

    3 closest PC World's to where I am now all had stock yesterday to put in those dummy boxes!

    You are correct that my order was done wrong and I was debited in error. And its over 2 months, not 2 weeks they have had my money. I was instructed when I purchased in August to roll up 22/10 and I would have W7 waiting for me. It was not. Surely a breach of contract.

    But, as has been posted again in this forum only today, in case of a breach of contract, an acceptable remedy is to refund the money. Which JL have already offered.

    But they might offer you something as a goodwill gesture to make up for having wrongly debited your account. Why didn't they reverse the charge when you complained about it, instead of it still being uncorrected two months later?

    Back to your problem tho, maybe you could try and contact MS direct and ask them to send you a copy of windows 7 (they will prob tell you you have to wait but its worth a shot if you want it asap). If that don't work you have only the two options as said above

    1) wait for JL to get windows 7 in stock
    2) Get your money back and spend an extra £100

    If I was you I would contact MS and try your luck at getting them to ship it out to you or give you a temp key until you get your one in the post :). If that don't work I would just wait for JL or try to ask MS if they can get you a copy from pc world or one of the others that had the limited offer price.

    Stores had a set number of pre order units at the special price and the limit was more than one per person. As I was allowed to purchase as a subsidised pre order they will have been within that allocation so I don't believe it is anything to do with limited stocks.

    My contract is with JL. Theirs is with MS. I doubt I would get anywhere with MS. The reason for the supply issue is for them and the supplier. I pre ordered in August and was instructed to go to the store and pick them up 22/10 at the time of purchase.

    As it is now they are unwilling or unable to tell me when they can get copies. I think JL should drive to PCW and pick up a couple!
