    The sickness we now learn was CERTIFIED by a doctor but you think it should be a "day off". So what you are saying is you doubt the doctors integrity that you were unfit for work?

    I could see why your single no one in their right mind could put up with your attitude. And believe me you are very offensive.

    I was off sick with flu just after xmas last year and was off over the new year bank holiday. Now I get paid for bank holidays but do not normally work them, they are added to my annual leave entitlement if you get what I mean. But even though I was certified off sick for the bank holiday, I was not then entitled to have that day back at another time, even though I didn't get the benefit of the bank holiday as I was ill.

    I think that if you are sick, you are sick, irrespective of when it falls unfortunately, unless it falls when you are on booked leave where you are usually allowed to book your leave to another time.

    Plus if like me the bank holiday fell during your period of sickness, the only way to get round this would be to resume fit to work and then be off sick again which would do more damage to your sick record as then this would be recorded as two periods of sickness.

    I really woould just put it behind you

    Thank you milliemonster for explaining to happyholly the FACTS of being off sick and the downside of not being able to work a bank holiday to get a day off in lieu BUT to still recieve FULL PAY for doing NO WORK!

    I never mentioned anyone being single, married, with partner, gay or otherwise, where does this come into your sick day scam?

    I am only offensive to you because I told you the answer to your question and you didn't like the TRUTH!

I must dash all this tripe is making me ill so maybe I'll "cop a sickie" tomorrow now ;) but I'll want a day off in lieu as well and for the days sickness to be counted as a day in work and a 30% pay rise, promotion to the next grade (director) and an 09 company car (the 58 plate is rather boring now)

    How can you be off sick and have a bank holiday at the same time? Its not possible! If I am off sick on BH or annual leave-I get them back. OP do you not have a personnel/HR dept, they may be able to clear this up for you..
  • All the companies I have ever worked for, including the government, had a rule that bank holidays were only paid if you worked the day or shift before, and the day after. Perhaps your company has a similar rule?

    In which case, you were scheduled to work but didn't work because you were ill. I don't think you have much option but to have it counted as a day's Sick Leave.

    As for the additional day's holiday you would normally get for working a bank holiday, well, you didn't work the bank holiday, so you don't get it.

    There is a bit of a grey area here though, and it depends on how your contract is worded. Are you actually contracted to work bank holidays?

    If you are, but then don't actually work the bank holiday, then it gets recorded as a day's holiday.

    If you aren't, but do work the bank holiday, then that's when you would be entitled to a day in lieu.

    Irrespective of this, it could be that the additional day is a benefit rather than an entitlement. In which case we are back to where we started - you didn't work the bank holiday so you don't get the extra day.

    You are quite right in that the bank holiday can't be recorded both as a Holiday day and as a Sick day. It is one or other. This in itself is worth clarifying with your employer.

    Sorry, probably not what you want to hear, but I think it's the way it is.

    My place of work is similar to Milliemonsters; if we are off sick on a BH, either as a single day or as part of a period of sickness absence, we do not get that day back and it is counted as a day's sickness absence.

    If, on the other hand, we are sick whilst on annual leave, as long as we follow the sickness absence reporting procedure and supply any self cert or GP certificate as appropriate, we will get the leave back. This arrangement is a policy of my employer and it is clearly laid out in our terms and conditions.

    If OP's employer has a similar policy, and the BH has fallen during a period of sickness absence, then it will not be given back and will be counted as a day's sickness absence.
