Hello, an update on my PPI I have been appointed with an advisor who sends me letters very frequently to inform me that it's under investigation. Approx £125, every penny counts.
Just concerned and confused about reclaiming my credit card late fees now, total about £100. Sent my first letter to which I received a reply stating that due to the Financial Ombudsman agreeing all fees can be investigated from April 2007 they are in no position to offer me anything. As account from 2005, and only charged up until 2006. Is this correct? and where do I now stand with this?

Write to them giving them one more chance or sue them in court.

Send the second one, ie pay up now or I will sue your !!! ;)

You could add that you will give them time to consider their position but a court of law is the place which can decide a fair fee. To avoid further legal costs and expenses on their part you will be willing to settle provided the money is paid out in full by x date.

That is news to me and, I very much suspect, will be news to the Financial Ombudsman Service!

You can download its complaint form as a Word or as a pdf document. Complete it, print it and snail mail it with a copy of the letter and all other documents.

    Keep a copy of everything.
  • To clarify April 2007, that was when catalogue accounts came within their remit under powers of the CCA 2006 which came into force at that time.

  • Hey guys,

I sent my I'll sue your !!!! letter and received pretty much the same reply...as follows:

"Whilst I appreciate your comments, the OFT has restricted its investigation to cc and has not consulted with Style Financial Services in relation to other products, incl. store cards. However, the Financial Ombudsman has agreed to investigate charges on store cards dating back to April 2007.

Having again reviewed your account, no charges have been applied to your account from April 2007 to January 2010 therfore no offer will be forthcoming.

I am sorry if my letter does not provide you with the response you may have been hoping to receive, but I trust I have explained the Bank's position concerning your enquiry.

For the purposes of the FOService, this letter may be considered as the Bank's final response. Should you remain dissatisfied you may progress your complaint with the FO, howevere, you must do so within six months of the date of this letter."

    What to do now?

I have sent all correspondance I have to the Financial Ombudsman Service, to receive a reply of we are getting through alot blah blah blah will investigate etc
