    Its actually 12 + 2 days not working days (i.e. 2 weeks/14 days). The account formally goes into dispute, as you say, the moment they sign receipt of the CCA. :D

    You need to do a SAR (£10) (Template here: #6) which requests the last 6 years of statements. You then add them all up and request that amount plus ststutory interest.

    You will not be able to claim back the interest paid on the overall balance (i.e. the PPI premium added to the overall debt creating a higher apr on the PPI element of the debt balance).

    I am now in a position to give them a total of what i need repaid as i have all the statements which cover the ppi period. Is statuory interest 8%.

    What do you mean they took the £1 CCA Statutory Payment and used it towards the debt? They cannot do this! When you send the CCA Request it clearly states that they cannot use the funds for anything other than the CCA Request.

    Yes i couldnt believe it, the postal order had written on the back the account number and cca request payment. I will definitely be sending that letter you posted :beer:.

    Yes the amounts are correct, it's just that i'm starting up in business and things are a bit slow at the moment.

    Are you 110% sure its as you have stated as i will need to put the date they defaulted in the cca default letter. Thanks i just dont want them getting of on a technicality(forgive my spelling:o).

    Hiya - nope, i'm a million percent sure mate :D:D

    I assume you're going to use the templates on my thread - which I amend and update (i.e. I know the processes - just inside out lol) :p

    In fact, I done this letter for you to send or are we onto a different debt? #29 At this stage you'd send this letter and not the dispute cos they have used your cheque toward debt repayment....

    However your account can be assumed to be in dispute - you don't have to spell it out to them.
