    Thanks for putting me straight on the business income/expense part, the phone/internet is a 12 month contract which i dont think they will let me out of.

    Ok, so this debt should be in dispute and thereafter they are not entitled to pursue you.

    Yes i sent a dispute letter with the cca letter so it will be in dispute you believe and if so do i still send a dispute letter after 12+2 days if i dont receive the agreement.

    I re-read the whole thread. I had assumed that you had sent the CCA request some time ago. Have you only sent this on Nov 2 2009?

    If so they have 12 working days plus 2 days (three weeks) to provide the CCA. It is however in dispute untl they produce it.

    Come back if they send you anything.

    And please follow up thoose links to recalims charges. The PPI is probably very easy to reclaim in total, all payments to date. The catalogue charges are easier to claim than bank charges as there is no legal action to delay them.

    Regarding the PPI have you any idea as to how i get the amount that i should be asking them to repay.

    For example do i just add all the premiums up and ask for that or do i add interest of 8% onto the total.

    By the way the money they took to pay for the ppi could have reduced my balance and i would have not had to pay 39.8% apr on the equivalent amount of credit.

    What do you mean they took the £1 CCA Statutory Payment and used it towards the debt? They cannot do this! When you send the CCA Request it clearly states that they cannot use the funds for anything other than the CCA Request.
    Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR). I enclose a personal cheque in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

    I'd be looking to send the following letter:
    Reminder to CCA Letter

    Dear Sirs,

    Account No: XXXXXXXX

    I refer to my letter dated XXXXXX in which I made a formal request under the Consumer Credit Act 1974 s.77-79 for true copies of the regulated agreement refered to in the above account number. You are reminded that you are obliged to supply these under s.189 whether you are the original creditor or not. I also enclosed the statutory fee of £1.00 for this action, which I note has been used towards the debt. May I remind you, in my original request I clearly stated that "these funds are not to be used for any other purpose".

    To date you have failed to comply with my statutory request and have defaulted in respect of this account. Additionally this alleged agreement is unenforceable until such time as the default is removed or enforced by a court of law. It is a further offence to attempt to enforce this alleged agreement until such time as the default is removed.

    Consequently I am ceasing all payments to your company until such time as this matter is resolved. It is also my intention to report this matter to the appropriate enforcement authorities.

    I await your prompt response.

    You need to do a SAR (£10) (Template here: #6) which requests the last 6 years of statements. You then add them all up and request that amount plus ststutory interest.

    You will not be able to claim back the interest paid on the overall balance (i.e. the PPI premium added to the overall debt creating a higher apr on the PPI element of the debt balance).
