    Just found this when they were advertising for people to recruit clients for loancheck earning up to 500.00 per day. hmmmmmmmmmmmm

    any pre-written contract term which puts you in a disadvantage could be classified as unfair - these apply for any business to consumer contract - if therefore, if I was taken to court for none payment I'd claim an unfair term /relationship

    All sounds so simple on there doesn't it, especially this bit:

    Answer the questions and at the end, it will tell you either you have not got a claim or you may have. Then you will need to send £10 ( cheque made payable to the creditor) and the process of reclaiming will begin. You keep paying the loan etc,, until all the money has been reclaimed. This is done by a panel of solicitors who are experts in contract law. There will be no debt collectors etc.. as you will still be paying. Once done, they will send you a cheque for the full amount plus interest.

    Nothing about having to attend meetings and court appearances there.


    Also:

    They get paid from a fund set up for this purpose, you do not pay them a penny.

    Now this will cost you NOTHING, absolutely nothing. The only fee you may pay is £10 ( payable to your creditor) so we can get the necessary information under the Data Protection Act, after that NIL. No fees at all.

    Remember, it will cost you nothing to reclaim what is rightfully yours. And also remember, this is run by solicitors so you are safe!

    Precisely. I still believe that our contract is with the solicitor and in my agreement the only way that you will incur costs is if you back out or if you accept settlement directly from your lender. My Solicitor is still saying that he is willing to take the case on without loancheck. How that will be funded I do not know but if they change the terms and conditions I shall be contacting the law society.

    I will give them a chance and if not as far as I am concerned they have broken their contract and I will persue this on my own.

    I was only ever claiming for the PPI anyway and did not realise that it was the whole loan at the time. I have claimed back 19,000 so far on here for my partner and business partner both on my own and through FOS but there were issues with these two loans. As a newbie at the time I thought I was not able or qualified enough to claim these back. Anyway you learn as you grow.

    This was Protected Investments wasn't it maxdp. I remember the name from here.

    Seems to be the same as mine (as far as I understand it anyway), my worry is that because I can't attend the meeting they want, can they say I've "backed out" by default I wonder ?

    I think you need to explain why you cannot attend the meeting. I had to fill in a questionnaire before mine went to a barrister. I wonder if that is what they are wanting to talk to you about. They should have facilities in place if somebody cannot attend this type of meeting. eg if you are disabled, they should have policies in place. If you had a sensory disability they would have to deal with that. Do you see what I mean? Just state your reasons and ask their response. THat was not in the original agreement they did not say if you cannot attend a meeting this agreement is cancelled.

    if a company has gone bust then the contract is invalidated and any debts owing go with the company - unless it something like a bank where the assets (ie outstanding loans / credit card debts) are sold to another company.
